Statement of Claim
Claimant says:
"A salesman, Jacob Ellsworth, came to the door of the friend I represent. Her name is Venka Williams. She is a naturalized citizen, aged 83, from Bulgaria and understands English pretty well, but now needs a fluent English speaker to be her advocate. That is I, Ruth Rutherford.

Jake was selling Devcon Security systems. He wasn't supposed to be selling anything in her mobile home park at 721 N. Sunset, Banning, CA because it said "No Soliciting Allowed" on the gate at the entrance to the park, but he came to her door at #103 anyway.

He proceded to tell her that his Devcon System was superior to her Monitronics System and that she should change over to his. She planned to change anyway after her contract was up in September, so she told him to come back in September. He convinced her, however, that she could get out of her contract by notifying them that she wanted out. He gave her a $100 bill to pay for any charges she might incur from Monitronics in the meantime.

She also told him, as I had instructed her in the past, that she needed to contact her friend first, and help her make the right decision. He convinced her that that wasn't necessary because he was such an honorable young man that he couldn't possibly do her wrong. He showed her the picture of his pregnant wife and talked glowingly of his future family plans. She described him as, "He so nice man! He have nice eyes, and show me nice picture of his family. I trust him!"

She trusted the wrong person! He proceded to convince her to sign his contract, that very afternoon he and his installer tore out her Monitronics System and installed the Devcon Security System, leaving her with a pile of Monitronic equipment and the $100 bill. He gave her a phone number and said if she needed any more money, he would give it to her through that number.

Needless to say, Monitronics wouldn't let her out of her contract, so she is left having to pay for both systems on a small Social Security check. The $100 has been used to pay the first two months remaining, but she has five left. She simply cannot afford it. When I tried to call him at the number he gave her, I got Pinnacle Security and an answering system...you know the routine..."If you know your party's extension dial it now..." There was NO reaching Jake Ellsworth.

I have tried to call Pinnacle Security to reach him, with no answers. I have called Devcon Security customer care number on four different occasions. Last week I was told that they would contact him by email and get back to me. They have never gotten back to me.

Mr. Ellsworth needs to send Venka Williams a check for $290 to cover the remaining terms of her contract with Monitronics. He should go to her personally so she could tell him off to his face for being a liar and a cheat!"
