Statement of Claim
Claimant says:
"I was told that my roof had faulty and improper materials on the underneath of the tile and that most of or all of the tile roof had to be replaced. There was one spot that had a small leak from a recent rain. Mr. Crandall's brother, Todd Crandall quoted a repair cost for that area of $2,500...but said that would only fix that immediate problem and that the "big job" needed to be done now, before the inside of the home suffered water damage. Todd Crandall gave me a "verbal quote" of $22,000 for the full "big job." Since his brother Don was a friend and one that went to the same church as I did the year before...I fully trusted him. Todd Crandall said that he needed 50% down and I gave him a check #3268 for $11,000 on 9/17/2013.
Since this all started because of the small leak, we all decided to see if my home owners policy would cover some or all of the claim. I immediately made a call to the insurance company, American Family and with the weekend, it wasn't until Monday 9/23/2013 that the adjuster, Scott Howlett was able to come to inspect the roof. It was in the afternoon of that day and upon a thorough inspection of all of the roof he gave me the following report. He said that even though the home was built in 1994, that it was an expensive, custom home and the roof was not only not eligible for an insurance claim...but the rood was NOT in need of replacing. He further stated that the contractor had not given me good information...and felt that since this was an "off season" for roofing, that he was looking for a job...at my expense.
I immediately called Todd Crandall, that afternoon, and told him to "hold" the job until we looked into this further. The next thing came an very angry call from Don Crandall, demanding to know the name of the insurance adjuster and said that he was coming over to take pictures of the "totally damaged" roof. He did come and was very offensive and left an impression with my wife that make her distrustfull of him.
I then had 3 others come look at the roof, two of which were licensed roofing contractors. All agreed that the roof was in good condition and would not need any repair anytime in the near future. Don Crandall stated that the underneath paper was the "cheap" 30lb weight. They all agreed that it was the better weight (I think they said 43lb) and was not "curling" as Don Crandall had stated.
They did agree that the one spot needed to be repaired and quoted me a price of $850 from one and $925 from the other. After that, I called and then emailed the Crandalls that I was not going to use them and wanted a refund of my $11,000 deposit. Todd then informed me that Crandall Roofing would keep my deposit, since we had a contract. I reminded him that there was never a written quote or a contract, only a receipt for my deposit...since Don was a friend...I trusted them. Plus, I had called him four (4) business days after I had given him the check.
Todd a few days later called and apologized and first said that they would do half the roof and when I said no, then said that they would do the repair for $2,500 and refund the balance...I said that they had lost my respect and business (after some nasty emails from Don Crandall) and that I wanted a full refund. If not, I would go the the Registrar of Contractors with a formal complaint.
My last "nasty" email from Don Crandall threatened me and said that he would send my refund, minus his time and costs. That was October 12, 2013...no further communications and "no check."
Gilbert Roofing found another area that needed a seal around a vent pipe, some minor adjustments and a couple tiles to be replaced and finished the job on October 23, 2013 for a total price of $1,250.
What do you suggest from here. I am submitting a complaint to the Registrar of Contractors."

  • I'm not paying you a dime until I'm finished with my lawyers. I emailed this dimbass company you hired and had no response, you lied to them and you lied to me ! I have three witness's ! It was way passed 15 days ! And I have the records, I know the right thing to do is to pay you back and it will happen because I have integrity ! Witch you have zero ! So when I figure out how much you owe me for the emergency repair we did on your roof, and my superintendent , and also my self inspecting your roof ! Witch isn't free ! And also the material I orderd for your roof , witch I had to return, cost me a restocking fee, witch also cost money! Your a deshonest man and I've talked to many people that you have stolen money from, and never took response ability for !!!! Pretty sad , for a temple recommend holder !!!!!!!
