Statement of Claim
Claimant says:
"We were charged 100.00 for backing into a trash can upon leaving the hotel, we did not go in immediately because we only pushed the can, we received a call to come back to the hotel because we had damaged the trash can. Upon our return to the hotel we found that the trash can had been changed, it was a plastic trash can , and was relatively high, when we returned it was replaced with a short metal and cermaic can with a dent in it, or a piece of the cermaic broken. Management was not available, and we were on our way to a wedding, i took pictures of the can and the back of the truck to show them that this truck could not have done the damage indicated on the replaced trash can, as we only backed up and pushed the can, not enough to cause any damage. The manager stated that they had it on video and a witness to the incident and that our only choice was to pay them 100.00 or stay and wait for the police to file a report and they would charge our insurance. We under duress paid the 100.00 in cash, because we had to get to the wedding that we had traveled 1300 miles to attend. The person behind the desk responed to me that on the picture i took, this crack in the can was too high to be done by the truck.
When the manager did make an apperance she was very rude and threatning, we had spent the night before at the hotel and had no problem. I feel that this is a racket with the hotel, and told them so, i also told them that i would inquire with the bbb, for any other complaints from resident being charged for trash cans. I feel if we had waited on the police, they would have verified that the truck could not have caused the indicated damage. Our room # Was 422, we spent the night on the 3rd of October. The hotel manager threatned to charge the room that had a credit card attached, which was room 420, that my brother and his wife had stayed in, he had nothing to do with it, was only riding with myself and my husband. We were trying to do the right thing and returned to the hotel, but as treated with hostility. My husband and i travel around the United States and stays in this particular hotel all the time and has never encountered any problem, needless to say, this has left a very bad taste in our mouth. I cannot with good conscience refer anyone else tto this company of hotels."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Mr. Mary Cobbs was never obligated to pay the $100.00. This was an option she choose rather than having the police called to file an accident report. Her truck backed into a trash can that had to be replaced. The incident took place directly under a camera, which is proof that no one replaced or changed the trash can before she returned. This point was never brought up by her until now. The fact that she didn’t stop after hitting the trash can spoke poorly on her behalf. We took the courtesy of calling them instead of calling the police first to resolve the issue and where approached with a nasty attitude. We had absolutely nothing to lose or hide and where whiling to work with her without calling the police. It is really disappointing to see someone behave this way after doing them a favor by not calling the police. We will defiantly learn from this incident and let the police handle this kind of problems. As of today we still have the video of the incident and are more than whiling to provide them, as well as the 2 witness to the incident.

    The so call cell phone missing is something that never took place. I understand that for some reason she is upset but there is no need to fabricate and further issues. A lot of the information provided is incorrect and fabricated.
