Statement of Claim
Claimant says:
"After being forced out of yet another home due to the landlord not fulfilling their oligations under the hud guidlines. I sought help help from the salvation army for assistance thru the hprp program for temp housing. I called inspection dept as well as other supervisors for assistance in retrieving a copy of the inspection report because that is what was needed in order to receive assistance from them. THe housing authority staff not only did not return various phone calls or return emails, but once I emailed their supervisor complaining about this and requested info on filing a formal complaint as well as info on porting out to another agency. Suddenly I received a response telling me to come in a pick up a move packet that would be waiting. When I arrived the packet wasn't ready & Iwas told to wait. I tried to charge my cellphone in their outlet then was approached by their on site officer saying I couldn't chrg my phone to call my job to report in late. I said "Dam"then left the building after I filled out a complaint card and dropped it in the box. They sent 2 officiers behind me requesting my drivers licence. Now I knew I had open traffic warrants and so did the housing authority. When I asked the officier why were they coming after me, they said someone inside was offended when I said dam and wanted to file a complaint, the housing authority sent those officier after me in order to send me to jail. During the arrest, the officier found marijauna on me, now this was on me due to the fact that my son found this around where we were temporily residing and I stuck in my purse so I could investigte later as to where it came from right before I came up there this happened and by the staff having me detained for no reason, I was caught with that crap on me. Not only did they set me up to go to jail for tickets but now Im facing misdemeanor charges for something that wasn't even mine in the first place. The housing authority immediately terminated me off the program before I ever even went before a judge or pleaded not guilty.I shouldn't loose my voucher over this and I haven't been convicted in a court of law. They set me up because I complained about their staff not doing their jobs and asking to be ported out, they also pretty much discouraged me from porting out by telling me that I would homeless even longer due to lengthy port-out procedures that they are totally in control of. Do I have any rights under these circumstances? I have children one of which is a type 1 diabetic and now we are truly homeless because of these oppressive people. I have already filed a formal complaint against the arresting officier because when he filed his report, he told the DA that he ran my drivers licence because I was parked in a handicap space which was a total lie because he didn't even know what car I was driving until after I was already under arrest. I know that I should have thrown the marijauna away, but I needed it as proof when I investigated where it came from and I had no way of knowing what I was walking into at the housing authority. They have ruined my life and the lives of my children because now I can't find us a place to live with this kind of charge against me. Today is Oc12,2010 and I have sent emails as well as left voice messages concerning my termination letter so that I could file an appeal to various management(Mark Theley) and staff supervisors (S. Meyers)and no one has returned my correspondence so that I could file an appeal and have a formal hearing about this situation and my termination. I also contacted my previous landlord about the return of my deposit and she returned my text stating she was well aware of my being terminated from the program as well as the reason I was terminated from the program. So I feel violated even more so by their staff releasing that type of info to third parties that should have no right to know this information. Therefore the City of Houston Housing Dept is also violating my privacy rights as well."
