Statement of Claim
Claimant says:
"I am a 75 year old retired history professor on fixed income. My wife is 72. We were looking for discount travel opportunities for meeting with our son and/or our daughter and granddaughters at various resorts. We met in Charleston, SC with several agents, including Greg Hunter with Bluegreen on September 25. We were with them for over 4 hours. They handed us 36 pages of legal language, including 11 single spaced on legal size paper. We did not read and understand much of it and trusted and accepted their explanations. We asked if this was a timeshare that we were considering and they told us that what they were selling was points and not a timeshare. We had been warned by friends about maintenance fees going up over the years and were told that the figure of $729 a year would never go up. We asked about how the points would be applied to resorts and were told that we would have to wait a month for that information. Bluegreen owns 60 resorts, most in the South. We were told that they were allied with RCI which looks to be a conglomerate of 4000 resorts all over the world. We were told that we would have to wait 2 months to see how the points would apply to the RCI resorts. So, tired and somewhat confused, we signed a contract buying 5000 points. We were also told that we could not get out of the contract after 5 days. So we were handed books and documents and went home. I was hoping that we could reserve a resort on the Gulf Coast for a Thanksgiving get together for our entire family. I looked in the book at Bluegreen Resorts and found that there were none in Mississippi where my daughter and granddaughters live and that there was only one in Louisiana in New Orleans and the week of Thanksgiving would cost us 15000 points. i checked the number of points required in Savannah and found that the one we were interested in cost 5000 points a day in the peak period and 4000 a day in the middle period. The least desirable period was 3000 a day. My children are middle class and like us could not afford these prices. When I asked about buying more points I was told that the maintenance fees would go up. So we decided that leaving the points and the maintenance fees to my children was not a wise move. We asked about RCI and were told to wait another 45 days to find out how many points each resort would require. We also realized that the number of points for each resort is not fixed or guaranteed, because RCI does not own its resorts. Thus dealing with RCI would always be shooting at a moving target. Our friends who had had a Bluegreen timeshare for 3 years said that they could never reserve the resort where they wanted when they wanted it. They had decided not to leave the high maintenance fees to their son along with the points, so they tried to get out. They were not able to sell their timeshare and lost $10000+. Thus I called and received the address of Bluegreen in Boca Raton and sent a certified letter asking out of the contract. Three or four days later I received a call from Ashley Anne Ridgely at 317-829-8511 in Indiana. She said that the time that I sent the letter was almost a month after signing the contract and the company would hold us to the 5 days that we accepted. I told her that we had paid nothing and were not going to pay anything. She said that the company would therefore ruin our credit if we did not pay the $12350 that we owed. We had also signed a document giving Bluegreen the right to do robocalls. We have been getting about 20 a day. This is their method of harassing us. We also signed something that I do not understand but it appears to give Bluegreen the right to debit our checking account. I have taken steps to try to prevent that."
