Statement of Claim
Claimant says:
"On Saturday February 27, 2016 I went into the dealership to purchase what I thought was a 2016 Camaro. but the one I had test drove was sold. I was led to believe I was coming in to do nothing more than paperwork. To my surprise that was not the case. They were able to locate a 2016 Camaro that I was willing to purchase.
On Monday I sent a text to one of the salesman to confirm our agreement on this specific Camaro. He agreed to the deal twice by confirming our deal in a text. When I arrived now the deal has changed. After a hour the dealership did see things my way.
I took the car home that Monday night around 9:15 pm without doing the walk around. Therefore while signing the paperwork that was a part of the paperwork that I declined to sign. Tuesday morning when I arrived at work I noticed at least two scratches on the passenger side door. I immediately contacted one of the salesman to add that to the list of things that they had agreed to complete. 1. Tint the windows 2. Clean the car 3. Put air in the tires that were low and 4. Take care of the scratches that I had documented.
The car was picked up on Wednesday, March 2nd and returned later that afternoon. If I had not inquired about what was done and what was not done I do not believe I would have been told. I contacted the salesman and he assured me the scratches would be taken care of on Tuesday March 8th. That is one week after I have taken the car off the lot. I did express my disappointment regarding the things that were not completed.
One the car not being clean; something about suds.
One the car scratches not being repaired; scheduling.
I see this as a delay tactic to avoid taking care of things to the point there is the possibility I could be held responsible for the scratches myself. Which I did not cause. My reputation concerning caring for my vehicles preceeds me.
I am requesting if available and possible in resolving this matter with All American Chevy Dealership here in Odessa off John Ben Shepherd Parkway."

  • The only reason they say customer satisfied is because they made it clear they do not wish to deal with me anymore. I was in agreement. But it is sad and scary when a dealership sells a car BEFORE they have clear title tot he trade in vehicle. This is not the first time this dealership has conducted this type of business.

What Claimant Wants Hide
Message from Claimant: After further consideration; I believe there should be additional compensation added in addition to repairing the damage on the car, giving me a 2nd set of keys, and detailing the Camaro, due to the fact whether they knew or not All American Chevrolet of Odessa should inspect any new vehicle prior to it being sold before leaving their place of business in additional to the a walk around that is done with the customer. I see this as a good business practice. I have not been able to enjoy the Camaro in any way due to numerous broken promises and delays. In truth the vehicle that I purchased was not new in the sense my position being the damage on the vehicle. I see my revised request for compensation due to a direct result of the frustration this has caused me, and the stress concerning dealing with the question; why and how a dealership that may advertise quality customer service but this is not true by any means in this case. Example; On March 8th when I walked into the dealership the first thing out of the sales managers' mouth is not we/I will make every effort to resolve the matter but rather where is the title to the car I traded in as part of the deal. My response was; once I am completely Satisfied, I will gladly give the title. I do not see myself completely Satisfied due to inadequate business practice. The sales manager did not respond. He just went and got one of his bosses. Concerning my position and definition of selling me a damaged vehicle not being new would be similar to buying clothing, shoes, furniture, or flat screen tv, whatever and in the process the business would either pull the item from the shelf or offer the customer the item at a discounted. And the customer understanding and agreeing they are purchasing a damaged item. I will not agree to purchasing a vehicle that had damaged and now is being repaired. That is still not NEW by my definition. Too much time has passed for me to just "settle." I see my request both reasonable and justified.
