Statement of Claim
Claimant says:
"I PURCHASED A TRUCK ON E BAY AND WHEN THE TRUCK ARRIVED IT WOULD NOT RUN AND IT HAD NO OIL IN ENGINE.
IT WAS DESCRIBED AS A RUNNING TRUCK NEEDING A LITTLE WORK. IT WAS A PIECE OF JUNK AND I COULD NOT GET SELLER TO PAY TO GET TRUCK RUNNING OR REFUND MY MONEY. HE REFUSED TO DO EITHER, SO I CONTACTED E BAY ABOUT THE PROBLEM AND THEY DID NOTHING"

  • Along with the other advice given, you should look into the arbitration procedure. If you are seeking a refund of your purchase price, however, you should specifically file a complaint against that party, rather than against the medium you purchased the vehicle through. Ebay has set up an arbitration/complaint procedure specifically for dispute that may arise, and you should try to take advantage of it.

  • You didn't mention having put oil in the truck after realizing that there wasn't any, but I'm hoping I can make the assumption that you did. The Ebay Buyer Protection would only cover the truck misrepresentation if the listing specifically said it was covered by Ebay Buyer Protection at the time of purchase/bid. If possible, see if it was offered or if the seller offered a refund period and what that period would have been. I think the seller should either refund the amount of the truck or pay to get it running, whichever you prefer because he sold you a truck that he said would be running. I'm not sure of the steps you've taken with Ebay, but you can open a case with them. (I can't really say how this works because I haven't bought an item, but the website to start is: http://ocs.ebay.com/ws/eBayISAPI.dll?CustomerSupport.)

  • Did you print out a copy of post regarding condition of car? I researched some information regarding Lemon Laws In California, and consumercomplaintagency.org. This maybe another alternate to file a complaint within their guidelines. I do suggest you go to the sites and read more info on your rights as a consumer. I also reviewed Ebay Buyer Protection Policies. You stated that Ebay did nothing to help you. I'm not sure of all of the steps you have taken with Ebay about your complaint or if it fell within how they handle complaints. Both of the site suggested that you try to find a resolution through arbritation. There is infomation located in Ebay Buyer Protection on arbritation. There is also information regarding opts agreement as user for Ebay services. This is explained in on ebay.com/help/policies/user agreement.
