Statement of Claim
Claimant says:
"I retained Delaney III to represent me in a minor guardianship case, and paid him $3500; at the initial meeting, we discussed the statute regarding jurisdiction and how it impacted my case; and agreed there were ways to discharge the guardianship. I paid him on or about October 29 2013 the retainer of $3500.00. About 6 weeks later, I contacted him to file an appearance in the minor's case in probate and he agreed to file his appearance. About one week later, I discovered he never filed an appearance;he ignored the governing statute for my case (death of a party during divorce); ordered obsolete case files on two petitions that were abated with the death of late husband; fraudulently ignoring the key legal issue in the statute - that nothing is left from the divorce proceedings; all temporary or pending issues were abated, thereby the Court lost jurisdiction over further actions; he ignored the statute and spent all of the money on cases and files that are no longer applicable; I want my $3500 returned for fraud, breach of contract, and negligence committed on the part of Delaney; I held up my end of the contract ; he did not; he intentionally concluded with a strategy that was not legally feasible and went against the statute. So now what is being disputed? His fees and his fraudulent spending of the retainer with no regard actually devising a strategy in my favor; his strategy is hurtful to me and my minor daughter; that he never intended to represent me in the case at a professional standard without fraud and deceit; money he wasted ought to be returned to me -- monies Delaney basically stole from me.
When you intentionally deceive another party, you should be rewarded; he performed no legal services, yet he spent $3000 in the first month on what I do not know; he was never in court; he never filed an appearance in court; he never wrote a motion; he never submitted anything in my case or made one legal move that bettered my legal status; first he was in my corner; then he took my money; once the check was cashed I never heard from him & he was not in my corner; what a fraud;"
