Statement of Claim
Claimant says:
"Complaint to Arizona State Bar
Michael Pittman and Bard Weinstein
1. After researching ads for representation, I contacted via web form Michael Pittman but was contacted by Bard Weinstein.
2. I paid the fee for representation and signed a fee agreement Docusign. I have an account with Docusign and when I went to review the document, it had been removed. I repeatedly asked both Pittman and Weinstein via phone, text and email and it was never produced.
After denying the plea agreement, I needed to know how much representation throughout trial would be.
3. Weinstein withdrew as counsel stating nonpayment.
4. When he sent me the plea agreement he said he needed a decision by COB or it would be set for trial. He sent it to me in March 2020, it was dated December 2019 and specifically states that it shall be deemed withdrawn and without effect if not signed within 30 days.....
I asked him for one with the correct date and he said "they're gone for the day, I need an answer". Although he said I did have a good chance if I took it to trial, feeling pressured because he said if I didn't take it he'd withdraw, I verbally accepted the plea and he withdrew anyway.
4. Weinstein did not attend my MVD hearing as he stated, he sent someone else that did not know my case and advised me on 2.14.20 that my 90 day suspension goes into effect at the end of the month.
5. Even though I told Mr. Weinstein I wanted to attend and have the opportunity to meet with him in person, he did not tell me until after he returned from a hearing here in Yarnell.
6. Mr. Weinstein told me I did not have to attend any hearing; it seemed he preferred it. Yet, I had to attend a Show Cause hearing after he withdrew as counsel without telling me or answering my repeated requests for the fee agreement. My family has money, how could I present how much it would cost without knowing myself?!
7. I included Pittman in my requests for the fee agreement and he sent one email saying he'd send it but never did.
8. I had asked for an attorney and the DPS officers laughed at me, Bard did nothing to further look into the matter. Honestly, his blanket discovery request was laughable and his complacency with the prosecution an insult.
9. Despite several reasons why the stop, arrest and search could have been challenged and hours of research and supporting case law provided to Weinstein he did not question me further or even consider a Motion to Suppress much less any other efforts to compel discovery in my case.
10. As of today I have still not recd my file or a copy of the fee agreement I signed.
11. Twice show cause orders were ordered because of weinstein's inept ability to manage his calendar.
