Statement of Claim
Claimant says:
"I Sharon Tillery along with my daughter Megan Tillery were advised that we were guaranteed a lease for a house on 62 Ash St. NE Rome Georgia. This was now approximately 3 yrs ago. The owner is Terri Daniels. He had promised "a little work needed to be done on the house so if we could give him a week or two it would be ready". We agreed and waited 7 weeks due to the fact he had found black mold in the bathroom and had to replace the shower. He kept saying from the beginning "I will get you guys a lease agreement drawn up but, by the time we were ready to move in he stated "I never did get around to printing off that agreement but since I took so long getting you in the house you have my word that you only have to pay the first months rent with a 150$ pet deposit and a 314$ deposit". I must say this seemed like an odd number for a deposit but assumed its what he paid for the shower. He stated rent was due by the 5th of the month and late after the 10th. He also stated that " as long as the house is in the same condition as when we move in we will get our deposit back". I wrote the check to him for 1037$. I do have a copy. We had several problems during our last year at the house from the water leaks/power problems/ants etc. I called him numerous times on these matters and it would take him sometimes weeks to show up. He himself stated I don't understand why your power bill is so high it makes no sense". He then sent his son over to go under the house about the water leak. His son did in fact find a leak and stated " it's pouring under there". He called his dad and advised him to tape it the best he could then he spoke with me and said "I will be over next week to check it". He showed up 3 weeks later. I did continue to contact him from time to time about the problems with the central heat and air. Then unexpectedly I received a letter stating I had 60 days to get out he was selling the house. We were completely shocked but not a lot we could do. I wrote him a letter with No response as well as sent him a text message. No response. I asked for my 314$ deposit back but he again did not respond. I cleaned that house from top to bottom literally. The neighbors stated "The house is cleaner than when you moved in". I went as far as to videotape every room and the outside as well to use as proof if need be. I realize 314$ is not a huge sum of money but every cent counts at my house. I have seen Mr. Daniels once since our move and he was at 62 ash with a relator placing the house on the market which he has every right to do. I was talking to my neighbor and was advised Mr. Daniels told him he had just purchased 2 more houses around the corner". You see we love this neighborhood and fortunately were able to lease a house on this very same street 3 houses down. I just want my deposit back as he verbally agreed in front of me and my daughter."
