Statement of Claim
"From the week of 9/26/11 to 10/2/11, the property management of Anna's Vineyard/The Reserve moved a group of day workers into a residential apartment community without notifying the tenants of their presence. Without prior notification, residence have been exposed to unsafe conditions and management has been negligent and remiss in protecting the rights and safety of the residence. The workers have unrestricted access to the community and move about freely as paying residence.However, because they are not paying residence their actions are dangerous and disruptive to residential life. Management has not only been inconsiderate of the health and safety of its residence, they are also in violation of their own term and condition article, which states: "Conducting any kind of business in the Premises or in the Community is prohibited..." and has compromised the safety and well-being of uninformed residence."

  • 09-27-2011 — Workers began roof construction in Evidence of someone having entered my residence in my absence was my entree bathroom sink.
  • 09-26-2011 — Workers moved into the housing unit adjoining mine residence
  • 09-28-2011 — Workers using a gasoline engine next door at 8 in the morning. Home still full of fumes at 5:00pm when I returned from work.
  • 09-30-2011 — Workers driving large construction vehicles in the narrow residential streets create driving and walking hazards.
  • 10-02-2011 — Sunday AM at 8:45 workers operate heavy machinery and violate Portage City noise ordinances and disturbing the peace of the neighborhood.
  • 10-02-2011 — Returning to my home at 4:00pm after escaping the noise for the day workers are on the roof and porch of the unit running an air compressor and using a staples. Was prohibited from accessing my garage or front door.
  • 10-04-2011 — On Tuesday through Sunday nights of this week, workers next door have repeatedly backed their vehicles into the adjoining garage. The exhaust of their vehicles facing my apartment my home has been filled with carbon monoxide fumes for hours at a time in my absence and even over night. Causing headaches and nausea.

    We apologize for any inconvenience that may have been caused during the installation of the new roofs. It is a very temporary situation that will be resolved shortly.
    It is the Landlord's responsibility to maintain the property and make necessary repairs, and these repairs will ultimately benefit the neighboring residents and enhance the appearance of your home.
    Again we apologize for any inconvenience this may have caused and want to assure you this is only a temporary restorative project. The health and safety of our customers and vendors are always a priority.
