Statement of Claim
Claimant says:
"Sovereign posted a misleading used car ad on www.cargurus.com in Spring 2015 describing this 2004 PT Cruiser GT Turbo with $5600KBB for $3000 and only 77,000 miles or $500/down and rest financed. They violated Florida Statute 501 and 501.2077 when they posted this misleading ad. The vehicle was NOT worth the KBB they claimed nor the price they asked for. I am a disabled over 60 U.S. Army Vet. It had 2 previous head gasket problems and was facing a 3d head gasket repair on top of other mechanical problems it had. Mr. Jerklin had purchased the car from the manufacturer; it was a lemon from the beginning. After paying for these costly repairs when it seemed like he was going to have to pay for yet another head gasket repair he put it up on Craigslist for $500. Two mechanics showed up who knew it had major mechanical problems because he told them. One apparently worked for Sovereign Automotive who has been accused of putting up wrecks for sale that cosmetically look alright with doctored photos but aren't. Sovereign put this wreck on their car dealer site with $500/down in yellow paint on front windshield knowing that this car wasn't as described in their online ad. It had a loose right tierod with leaking power steering hoses which made it dangerous to drive. The car could literally go out of control and kill somebody because of its steering probs. It also had an already overheating engine made worse by leaking coolant hoses and adapter not replaced. One of these mechs wrecked the car because the oil dipstick was jammed into the squashed oil chamber, upper/lower motor mounts needed to be replaced, broken manifold cover, needed a new battery, etc. When I specifically asked if it had any major mech probs I was assured by BOTH Sovereign mechanics and Dealer it didn't knowing full well it did. When I got to FL DMV after purchasing it ONLY after their verbal assurances and being pressured and coerced to do so for more than an hr I said I wanted a full refund because it had eng probs. It had the "check eng" light on which it had when Leo purchased it. Leo lied again saying it was "just a sensor, take it to Auto Zone to be replaced." ALL of them at this car dealership knew this car was a dangerous wreck and shouldn't be driven locally let alone long distance. It also had a 225,000 discrepancy between title and the odometer mile reading.

Sov's mechs purchased this wreck from Robert William Jerklin III whose name they deliberately never transferred the title out of on purpose violating Florida Statute 319.22 and 319.33 when they forged his name on the Bill of Sale. Mr. Jerklin and I have never met. He did not sell me this vehicle nor did he sign the Bill of Sale. Even Sovereign's ins co knew it was a dangerous wreck but changed my Carfax which showed 294,490 to 79,717 actual miles when the NC Cert Mech evaluated it. That is illegal. In any event I wanted my money back within ONE hour of purchase. Uri G. who runs this Hollywood, FL dealership forged Mr. Jerklins, name, address and sig on the Bill of Sale violating FL Stat 319.33. In addition to that Leo was coercing, lying, pressuring, etc. me for more than an hour in Sovereign's car dealership's office violated Florida Statute 825. I was worried about how to get home, being coerced to buy this car not as advertised, and lied to repeatedly by Sov mechs. Sovereign knew the whole deal was illegal which is why he never put the correct vin no. into inventory and said it was a private sale. I never went to anybody's home ONLY the dealer lot. Uri had me pay this Leo crook saying "you won't be back down here within 30-days under my warranty" knowing full well the mech I didn't know. They knew I'd find out. Sometime between purchasing it from Mr. Jerklin and putting it on their sales lot car was wrecked and not repaired making it dangerous to drive ANYWHERE.

Sov deliberately didn't include the Carfax in their misleading online ad. I had sev people look at ad incl other dealer. I didn't need to fly all the way to FL for a fraud. Their ins co SureTech has now illegally changed the Carfax to read 79,717 odometer miles. We don't know how many actual miles it has on it because it wasn't wrecked when Mr. Jerklin sold it to these mechs with the understanding that they would do the repairs on it. Somebody drove it. Mr. Jerklin did not sell it to drive nor should it have been on a dealer's lot for sale at all. Sov did not put FTC-mandated Buyer's Guide in win of car on purpose so that car's cond would not be shown.

I contacted Sov via online, referred to Leo by text and cellphone being told "runs great, come get it" "has no engine, transmission, electrical or frame damage." It had 3 of the 4. I was pressured to buy the car all day by Leo who kept lying right in front of Uri. Uri could have intervened at any time and told me the truth. He knew I was worried about how to get home, whether they were lying to me. after they told me over the phone, in person and by text msg it had no major probs. They both spoke in Hebrew so I wouldn't understand the true cond of the car. I asked many times to let it be seen by an outside mech but they wouldn't let me, I had to go with their mech. I had another party on the phone at the time. Sov's mech said he had put the car on the computer and run the codes which it passed when in fact he never had. Marco the soldier/mech did an illegal NC Veh Insp showing it passed when it didn't cause he wanted to steal the car repair money and not do the repairs. Sov's mech didn't do oil change as claimed cause the oil dipstick was jammed into oil chamber from wreck, upper/lower motor mounts needed replacing, needed new battery, replace manifold cover, and already had head gasket repair that turned into needing new engine PRIOR to me buying it. NONE of this was disclosed to me by any of them. I said to refund me due to the eng probls I said it had but didn't have any way to contact Leo since Uri put Robert William Jerklin's name, address, and signature on Bill of Sale instead of Leo's or Sov's. Uri forged Mr. Jerklin's info NOT Leo just like he posted misleading ad NOT Leo. BOTH culpable. Mr. Jerklin is an innocent victim like I am. He is being made out to be a car dealer selling wrecks. These people are the crooks. Uri knows exactly where Leo is which is why they didn't do a proper title transfer so he couldn't be found.

I have filed with various gov orgs,media outlets, etc. At the time I thought it was just odo fraud. It's far worse than just that. It's MAJOR fraud violating many FL Statutes. Mr. Jerklin sold the vehicle to them and they knew its mech condition. I never agreed to buy a car with 3d head gasket prob and other dangerous mech conds. Its disgusting that now their surety bond ins co is also committing fraud on top the car dealer and their mechanic's fraud."
