Claimant says:
"In August of 2012, I delivered my ATV, Polaris 500 to the Small Engine and Repair Services for service on my ATV. The owner and operator promised me that he would have my ATV back to me before hunting season started (OCTOBER). Well, it's now December of 2012 and my ATV has not been fixed nor, returned to me. I have stopped by this business on a weekly / bi-weekly bases since August for updates on my ATV because no one at this business has the professionalism to call and give me an ongoing update on my ATV. In fact, the only time I've heard from anyone from this business is when they wanted me to pay for the Carburator that was needed to repair my bike. first he said it was the fuel pump!! then, after several weeks of this he said carburator. on Thursday 27,2012 I stopped by to get an update on my ATV. The owner stated that the part was being shipped. I told him that should have had it already and my ATV fixed and returned to me for hunting season. He then stated "well you can take it." I then said" know you are going to fix it and return to me as promised."

  • I’m not aware of whether this could be potentially applicable, but under most states’ laws, a mechanic is required to give a written estimate of repairs for vehicles. It doesn’t seem from your claim that you were provided with this estimate, as it seems that the company has not only not figured out what is wrong with your ATV, but has also not established what needs to be repaired or let you know an estimate of costs. Perhaps a certified letter to the business indicating that you were not provided with this written estimate, and requesting that information and a timeline as to when repairs would be done. Be sure to indicate your issue with the length of time and the original time constraints, so they can take that into consideration in an estimate.
