Statement of Claim
Claimant says:
"Hired this company to fix the leaks in our roof of our home. They gave us one estimate of $1000.00, then later had a Roof Contractor come out and estimate it again for $1680.00 this time. I talked to the roofer and asked him when he would be able to fix our roof, he answered by next week, RoJohn didn't send him to do the job for a month. My wife and I were present as our roof was being repaired, and saw 100% of all materials used to fix our roof, but certainly didn't come to more than $500.00 worth of shingles, sheeting and flashing. We asked RoJohn's for an itemized bill showing the labor costs and materials used, doing some roofing work in the past myself, I knew the materials used and labor wasn't even close to $1680.00. RoJohn's refused to send me an itemized statement, they sent me a piece of paper showing $1680.00 nothing more. I contacted them two more times, and they refused to send me an itemized statement, and I know it's because they can't justify the materials used, knowing my wife and I saw all the materials used by the roofing company. They also included a garbage dumpster in their repair estimate that was never delivered. On the bill I received on June 28, 2018, they state they will add an additional 18% interest if the bill is not paid within 30 days. They say I signed a contract for $1680.00, and I have no problem paying it minus the cost of the dumpster that was never here, but I want a statement showing the total labor costs and material costs. I've never hired any contractor without an itemized statement given before the bill was paid, and I expect one this time. The roof contractor also drove on our lawn and left tracks in several places, they were never fixed properly by RoJohns. In the attachment I'm quietkool1212@yahoo.com"

Additional Communication Between Claimant and Rojohn Home Improvement Hide
  • Aug 23, 2018, Claiming party added:
  • I have decided to hire a sod company to fix our yard, so the cost of that will be deducted as well as the dumpster that was never delivered.

  • Sep 27, 2018, Claiming party added:
  • We sent $500.00 to RoJohn today to resolve this roof repair dispute. I deducted $150.00 for the dumpster that was never delivered, and $230.00 for the sod installation to repair our lawn that the roofer tore up that RoJohn never repaired. We should also deduct the cost to hire another roofer to fix the sloppy flashing job, but we just want this finalized. We feel we should have never paid the $500.00 to resolve this, but we're just hoping RoJohn will try to do this to someone else, and they'll sue them and shut down their fraudulent business for good.

  • Oct 01, 2018, Claiming party added:
  • Well we had to stop payment on the $500.00 check we sent RoJohn, our roof started leaking again last night in the same spot they were supposed to have fixed. Now here we are, with a leaking roof and we've already paid RoJohn an $800.00 retainer. They are under contract with Owens Corning Roofing Products to stand behind their work. Hoping they will honor that and do what honorable businesses do in this situation and fix the problem as it should have been fixed originally. We don't want to have to sue them, we just want our leak fixed.

  • Oct 03, 2018, Claiming party added:
  • Well, we have contacted RoJohn twice to come fix the leak that they failed to fix in the first place. Talked to Rick Johnson yesterday from RoJohn, he was the first to estimate the cost of our roof repair for $1000.00. He stated yesterday we needed to get our whole roof replaced, that they couldn't just fix the area that was leaking, is this Fraud or what? They sent a roofer named Daniel who estimated the roof repair after Rick, he estimated the repair cost at $1680.00, and talked to me personally that same day and showed me exactly where the leak was coming from and said it would be no problem fixing it. This leak has already ruined one cabinet in our kitchen, if the leak's not fixed, it's going to eventually destroy all the cabinets and sheetrock SW of our kitchen sink, mind you this roof repair attempt was done less than 90 days ago. Since RoJohn is an Owens Corning materials contractor, we're hoping that their warranty on their materials will force RoJohn to come back and honor their contract, if not then RoJohn needs to return our $800.00 retainer so we can hire someone who can do the repair properly.

  • Oct 06, 2018, Claiming party added:
  • Well it appears RoJohn is willing to refund our money and call it a wash. I won't hold my breath until I see the check.

  • Oct 16, 2018, Claiming party added:
  • Well my Wife called RoJohn on 10/5 and then again on 10/12, both times being promised that our $800.00 retainer check was in the mail. First time by Pat McCarville and the second by the owner Mike McCarville. As of this morning we still haven't received it, and since their failure to fix our roof leak, we've received substantially more damage to the interior of our kitchen walls and cabinets. If RoJohn doesn't keep their word and return our retainer by the close of this week, they will be paying much more than just the $800.00, we will sue them for the damage to our lawn, our roof and interior of our kitchen. I can only imagine how bad the roof job actually was done considering how sloppy the flashing job was done. We had another roofing company come out last week to asses what RoJohn did, and they said it was done all wrong, especially the flashing.

What Claimant Wants Hide
Message from Claimant: I will be willing to settle this dispute, deducting the cost of the sod that we hired to be installed, and deducting the cost of the dumpster that we were billed for that was never delivered. Also considering the fact that RoJohn claims we signed a contract that was never signed, and them not fixing the sloppy flashing job, makes this a breech of contract, because they claim to stand behind all their work done, due to being contractors for Owens Corning roofing products. This is my final offer, I won't pay, nor do I feel I owe anything close to this amount, I just want this issue to be resolved and finalized.
