Statement of Claim
Claimant says:
"I reside in a property managed by Olen Properties in Summerlin - Las Vegas, NV. I have resided there for over 5 years. I cannot get the onsite manager to return my calls, or communicate with me to resolve issues and work orders relating to the unit. She is the 4th onsite manager since I've lived there.
Problem: They are trying to tell me a slow leak that they didn't repair years ago (they simply painted over the water stain) is now tenant negligence and failure to report and I must pay for the repair and damage it has caused. This after obvious water stains were present and could be seen by visual inspection on annual walkthroughs.
Problem: There are rats in the walls - I have reported hearing them at night - they appear to have employed a noncohesive plan to address the problem between the onsite manager and pest control - there is no comucnication between the parties and the issue is still there after 6 weeks of notification with no apparent resolution in sight.
Problem: I cannot get the onsite manager or the regional manager to return my calls or appropriately deal with issues. The onsite manager has unilaterally decided against me without speaking to me or giving me the reason behind her position. I received no written notification of their position, it was only found out after I called to find out the status of the work order for the repair that they weren't going to fix it and/or that I would have to pay for it. I received no information on what that repair might cost, the the extent of the damage, bids on the work that must be completed or the basis for their decision. Ive not been given any information and no chance to respond!
I just received my new lease terms and with rats in the walls and no communication about the existing problem in the unit they increased my base rent by 4.3%. I work in real estate lending and commercial leases have at the most annual 3% CPI increases - I feel as though I am being singled out now and treated unfairly."

  • Landlords cannot raise rent, refuse to renew a lease or evict you because you complained about a habitability problem. That would be considered illegal retaliation under Nevada law.

    Retaliatory conduct by landlord against tenant is prohibited (NRS 118A.510)

    Examples of retaliation include filing an eviction lawsuit, terminating a tenancy, refuse to renew, "increasing the rent", or decreasing services. (NRS 118A.510)

    Retaliation is assumed if the Landlord takes such action after Tenant complains to the landlord about unsafe or illegal living conditions. (NRS 118A.510) however are exempt in the case of a rent increase if they can determine that the increase in rent was applied in a uniform manner to all tenants.

    Have you increased rent uniformly to all tenants? After I complained I received a rent increase. You were made aware of the rodent issue in early August - there are no rodents in the unit, so you cannot blame tenant neglect as the cause. They are coming in from the outside.

    On August 30, I emailed you and requested a different unit as I believe it is not healthy to live in a place where rodents live and I can hear them trapped in the ceiling and wall - for about 3 weeks you were aware of the issue. Who knows how many are there and if one dies there will be maggots.

    On September 1st, as if insult to injury I receive notification my rent will increase. This after receiving my email and multiple complaints about rats. This, after a rat chewed a hole in the kitchen. It wasn't until two weeks later when I called you and asked about it that you told me my transfer request was declined - even though I never completed a transfer request or applied for any such transfer. I had to call you to ask about an update - there was no follow through on your part about any decision made or how that decision was made. You refused a transfer but invited me to renew the lease at a higher rate.
