Claimant's opinion: The Leaf-Guard has a lifetime warranty which has been filed on October 7, 2009.
Attached please find the lifetime limited warranty that Mr. Waters purchased.As you can see it does not warranty that the gutters will never clog. The product is made to help prevent debris from clogging the gutter. The theory behind that is that leaves and other debris will dry off and be blown off the gutter guard. When there is an excessive amount of pine needles as there is in this case the system can obviously be overwhelmed. I have also attached pictures of the volume of pine needles falling on this gutter system.We did the job in 2009. We went back in the fall of 2010 and took piles of pine needles off of the roof and gutters. We went back twice more in the fall of 2011 and removed pine needles from the roof and gutters. The pine needles on the grounds were waist high where raked up in some areas. In January of 2012 we notified Mr. Waters that we could no longer help him with the excessive amount of pine needles. The only way for him to alleviate this problem would be to trim the branches closest to and over his house. We have installed gutter guards on hundreds of homes and it has been very effective. We do not feel that Mr. Waters should get a refund because we gave extra services for two years and also completed the original installation of the gutter guard. We believe that we went above and beyond in this case.
Before I purchased the Leaf Guard system, I inquired if it would keep the pine needles from accumulating in the gutters and was told by the salesman/representative that the pine needles would fall off the Leaf Guard. The statement re: "the pine needles were waist high" is untrue. I told Armando that I have a compost pile(which is still in the same place) and the pine needles were only atop the compost pile. No way were the the pine needles in my yard waist high! I do not know of ever seeing any pine needle accumulation waist high even in the forest. That is an absurd accusation.
I looked at your attachments, the e-mail you sent dated Jan. 6, 2013 was sent to to: e meyewww@ sbcglobal.net is not my e-mail address, my wife's e-mail address is eyeww@sbcglobal.net. I have enclosed the brochure to the claim page to show that it says it would prevent pine needles from clogging the gutter. (Underscored by me). Also the pine trees were present when I purchased the product,and I asked if it would prevent pine needle accumulation and I was told unequivocally that it would. I called to have the product placed correctly the day after it was applied because I personally got on a ladder to inspect the job that was done and discovered that there were gaps in the application,so your workmen had to return to apply adhesive the material where they had not originally. Your sending men out to unclog the gutter was not"above and beyond the call of duty", it was another attempt to cover for the products shortcoming. I would not have purchased the FloFree if I knew I had to continue to clean my gutters, that would be a foolish purchase and waste of money, and as a retired veteran and State worker, it is not money I have to throw away. Your statements about" no company can keep my gutters from clogging" is at best unfounded and an evasive statement. If as much energy was put into living up to your agreement and customer satisfaction as you are putting to avoid doing the right thing, I would not have to continuously write you. I am also attaching the pictures I sent you to expedite sending your men to unclog the gutters.
Interesting that your salesman assured you he never said the needles would not pile up, last time I spoke with you, you told me Joe Lastrina had retired. And I have had my trees trimmed when I had a 75' oak removed. Look at the attached brochure that I was given, it says:"Flo-Free prevents leaves,twigs, pine needles snow and all other debris from clogging and damming the natural flow of water". So for you to say that the needles are on top of the product makes little sense. The damming has been occurring when it rains, and it has rained a lot this season as you know. Here is a picture of my compost pile, I never rake pine needles into any waist high piles, ever!
