Statement of Claim
Claimant says:
"On 3-27-17, my wife and I were returning home (Toledo area) from Illinois.  We noticed an unusual sound coming from the front left wheel, so we exited off I-75 into Lima, OH.  On our way (at 15 MPH)to a Firestone dealer, the wheel came off as a result of 5 studs having broken off from the wheel hub assembly.  We were fortunate that it did not happen at 70 MPH on I-75.  The car was towed to the Firestone dealer in Lima, OH, and we were told that he could have it fixed by mid-morning.  He informed us that this occurs for one of three reasons:  1) studs wearing out (rarely, and what are the chances that all 5 would wear out simultaneously?)  2) under torqued lug nuts, but Midas had rotated the tires 2500 miles ago, and if the lug nuts were not properly tightened, one would notice as soon as you left the Midas store  3) OVER torqued lug nuts, and he said that this was the case in most situations where the wheel comes off, as the studs get stretched and subsequently weakened from this action.  The cost of a new wheel hub assembly was $390.00, and lodging at a Lima, OH Fairfield Inn (we were only 65 miles from home) was $115.00.
I called Midas the next morning, and they said to bring the car in when I got back to Toledo.  When I did, I was told to submit my bills to them, and they would fax them to the District Manager.  In addition to the wheel hub assembly, there were 2 dents in the side panel just above the wheel.  These were caused by the car tilting to that side when the wheel snapped.  A body shop in Temperance, MI performed an estimate to repair the damage at $772.03.  These 2 bills were faxed to the District Manager, Mark Adkins.  I did not include the hotel bill, even though we were inconvenienced to spending the night in Lima, OH only 65 miles from home.  I was told that Mr. Adkins would be in touch with me.  After waiting approximately 3 weeks for the phone call, I called him twice on 4-26-17 - both times, the call went to voice mail.  Finally, after threatening legal action, he called the next day.  Basically, he said that without the broken studs what proof did we have?  When I told him that when our car was basically straddling the shoulder of the road and a bank leading to a ditch, it would have been impossible to locate the studs in the weeds.  Both my wife and I are retired and in our 70's.  I could not believe how rude and disrespectful that Mr. Adkins was, considering that we could have been seriously hurt or even killed had the wheel come off at a high rate of speed on the interstate.  The manager (Bob) at the local Midas where we have had literally all repairs on all of our cars for the past 30 years is a former student of mine.  He was very apologetic and cosiderate about our ordeal, something that Mark Adkins was not.

    Third paragraph: . . . with whom I spoke (Tanisha), took notes on my complaint, and assured me that I would be hearing from Corporate Office, but as of now, I have heard from no one. Does anyone from Midas care about the rights and feelings of others, especially 30+ year customers?
