Statement of Claim
Claimant says:
"I spoke with Mr,Prendergast on sept/2011 about a divorce but not to file until I informed him that I was ready as my wife was hospitalized at the time,we made no contract at that time,He promply filed,made a request for payment through my credit card eventhough I told him not to do so.I informed my credit card co,not to pay him when I saw his charge on my stastement but I was too late,they had already sent payment to him.Now I cannot reach him as he has closed his office & I cannot find him,also we had not discussed how much he was charging,we made no contract,no paperwork was given to me,this divorce was on hold until the ok from me was given & now he's gone.what can I do."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Mr. Jackson came into my office and signed a contract with me. I agreed to file his divorce case.

    He also agreed to bring his wife to my office to sign a waiver. They have called a number of times and she was not happy.

    I think one of two things; he is trying to show the wife he never really wants to file for divorce or he found someone cheaper.

    The case is accepted on a retainer basis and the funds he paid vested to me and I did as he instructed. I also never charged him 2800 twice, only one time."
