Statement of Claim
Claimant says:
"I have been a 20 yr customer of this location and have always been treated with excellent service. Then recently I became aquatinted manager Chris and waitress Valerie who seemed comfortable enough with me to share their life stories with me which included a past life and current life of gang affiliation. It was awkward at the time to hear but after a few visits it was bothersome to see them abuse their authority from afar and also confirming it with other co-workers who confided in me. Then soon after waitress Valerie began to become hostile towards me for the past month causing me to become uncomfortable during my visits. I would still come on a regular basis as it was my routine to do so. It's my belief that both the manager and Valerie became upset at me once I didn't take their openness to me about their life as well as they might have hoped. I too during my younger days were once very familiar with the inner city life and it's complications and struggles. After hearing about and witnessing their abusive behavior towards employees, I tried to avoid their work schedule to dine in peace without hostility which began to grow. Then in late June, Valerie told me to my face in the presence of my daughter that she " hated me". I didn't know how to take it other than to shrug it off, but my daughter took it as literal, but I turned a blind eye because I love my favorite place and booth. Then two weeks later on July 4 th while I sat at my booth, Valerie took what looked to be a break and met with some of her friends who were gang affiliated as they stared angrily at me through the outside window. As I stared back curiously they began to use hand signs and make hurtful gestures towards me. I immediately felt threatened and left as soon as I could without harm. I returned a week later to file a complaint against this employee and manager Chris refused to hear my position in the matter. Which started out as a quiet verbal conversation turned physical and became loud and disruptive on her part when she grabbed my arm and forcefully tried to remove me from the restaurant. I quickly remembered back to when manager Chris boasted once to me that Valerie does most of her bidding at work and off the clock as well. It's my belief she was going to protect her co- worker at all cost. Nevertheless I asked for information on how to file a complaint by the corporate office. But again she refused to help and pushed me out the door. I refused to leave and asked her to call the police in which we both agreed to let them handle the dispute. I waited for awhile and I decided to leave after such an embarrassing moment and to be considerate of the other patrons who looked on. As soon as I left I was pulled over down the street but after conversing with the authorities I was allowed to leave. I'm a disabled and retired firefighter for the city of Phoenix and have a long relationship with this establishment. This manager and waitress for the past three months have made my dining experience at this location a miserable one in each instance. It is my request that these two individuals at this location be reprimanded or removed. They certainly do not exhibit the qualities needed to provide a safe environment or for a complete dining satisfaction. I felt I acted in a civil and professional manner and the cameras pointed at us during this dispute will clearly show her actions towards me were out of order. It is my hope that I could return and not feel threatened and have my food tainted."
