FDB was awarded, and Brasken paid to FDB, all amounts requested by FDB, including interest. Brad Furfaro, licensed Landscape Architect, is highly regarded in the St. Louis community, both charitably and professionally. Brasken stated in court that he suffers from a mental health condition, which makes it immoral and unethical for FDB to discuss Brasken’s condition in a “complaint” forum such as this. In turn, it is also unethical for PeopleClaim.com to accept money for cases that have already been tried in our legal justice system. "

I came to this claim via "reviews" about Peopleclaim when I was checking it out to see if I wanted to try it before going to small claims court. Funnily enough, Brad Furfaro's really awful response to a complaint was what convinced me that this site does an honest job and fills a need. I did use PeopleClaim and my complaint was directed by them to the company's lawyer, who had a very different response than the one I'd received myself from a rather ignorant manager. My claim was resolved to my satisfaction in five days. We negotiated a final settlement, I signed the NDA, and then closed the claim and cashed my check, and we all moved on.
When I read this claim against Brad Furfaro, as an enthusiastic gardener myself I can agree that hostas shouldn't be planted in full sun in a hot climate, and that a rosebush shouldn't die after being transplanted. I've carefully transplanted many rosebushes and other plants and shrubs, and never lost a single one. An inch of mulch is completely insufficient. It should certainly not be spread over debris. All that is what happens only when a crew aren't supervised.
It is interesting to me that Brad Furfaro didn't respond to any of these reasonable complaints by adding pictures of a healthy rose bush or hostas planted in the shade, thus proving the complaint baseless, but instead went with "mentioning" the claimant's "mental health condition" as a smear tactic (very unethical!) and then enjoyed several complaint sprees of his own. Because he included the claimant's name while piously talking about ethics, it is very clear to me that he intended to embarrass the claimant into closing the claim. Good for the claimant not falling for that one.
Based on Brad Furfaro's response here, I would guess that he had the same kind of response to his customer when he initially complained, and that's what led to the court case and claim. I wouldn't have wanted to pay a high final bill for a shoddy job, either.
I accept that I don't know the full story here, but based on the claim and the response, and on the fact that the claimant had worked with a patio company with no problem, I am quite sure that the contractor did a sloppy job. I just don't know how sloppy it was, and what kind of remedial work or reduction in the final bill would have been appropriate. Even though this is very old claim, I would encourage the claimant to add even blurry photos.
