Statement of Claim
Claimant says:
"Hi, my name which I will not disclose at this time, was a patient of Dr. Spivey of Easy pay Dental in Ocala, Fl.. my complaint with them is the enormous amount of money that was charged and as of yet I don't have a complete set of Dentures to wear it has been a nightmare. this has been going on since Feb./2016 it seems they had an excuse for every delay. the temporary set they gave me never fitted and I couldn't wear them, they sent my permanent set out to be made and when they came back they seemed as though they were made for someone else.So it has been one upset after the other, i would never recommend this chop shop to anyone. One more thing when they put the implants in my gums they never checked medical conditions ongoing in my case, because I was on the verge of Kidney failure and the drug used to put me under later caused my Kidneys to totally shut down and now I am on Dialysis. So I want a refund for monies paid to them. I still don't have my Dentures

DoctorSpivey Is not a good dentist I paid him $20,000 to do implants that he said would work for me and couple of the implants I had to have them removed he didn’t hold up to his word every time I call to tell him something was wrong he ignored me Told me he didn’t need to see me anymore he is a horrible dentist And I have to say pulling his license is the best thing that happened

This story is one sided. Did you tell the Dr about your kidney and medical condition? It seems that your kidneys would have failed regardless of the procedure done. And the fact is, dentures don't fit like real teeth. They take a long time to get used to and feel somewhat comfortable. Were you keeping up with follow ups for the adjustment of the denture? So many unanswered questions that it would be unfair to make a decision based on this story.

  • On August 25, 2017 Dr Ben Spivey's dental license was revoked by the Florida Board of Dentistry.  Documentation regarding this case will be posted on the Florida Board of Health's website within 3-4 weeks. My father was scammed by this dentist which resulted in the unnecessary removal of 14 teeth, severe infection and $20,000 in financial loss. It has been a nightmare. A malpractice claim was submitted to the Florida Board of Health in March 2015. At the same time he approached several attorneys to represent the financial loss this case.. They stated that the malpractice claim had to be confirmed first by the Florida Board before he could file suit against Dr. Spivey. It has taken over two years for this case to come before the Board for a decision and now that it has the attorneys are saying that the statue of limitation for this type of case has expired! This is an outrage! It appears that we are all SOL unless someone can suggest a legal firm that is willing to fight on our behalf.

If Dr. Spivey is a member of the local Dental Society, the patient may consider going through their Peer Review system to determine if their complaint is valid, and if any refund is in order for treatment below the standard of care.

  • What type of implants where placed (conventional or mini), how many. Are the implants well placed and fully integrated? Whas this a Denture after pulling out teeth or the teeth had been extracted earlier? Are we talking about top and bottom dentures or one or the other? What was the medical condition he is referring to and what medications was he taking? How old is this person? What medications were prescribed by the dentist?
