Statement of Claim
Claimant says:
"I took my pump in on January 1,2011. on the 19th I paid Erik $528.00. The pump was brought back on November 11,2002. Erick stated he needed to take pump back to his shop at Cal Spas in Bakekersdield, Ca. I was told due to the length of time there would be no charge, I was also told then the very same thing by a man named Bruce. He tried to blame it on the way it was hooked up, but when I told him two PGE emplyees did it, he never said another word. This isn't the first time Erick had to fix the pump, in 2002 he had to fix the pump and 220 element. So, if anyone hooked it up worng, it was him. Apparently, Erick is sick a lot, when he's not in Bruce comes from Oregon to run the business. Bruce was the one that finally got things going on my pump, he said it had sat there since 1-19-2011, untill 11-22-2011. I called constantly and no one would answer the telephone. I finally went to pick up my pump in April, 2012. Erik got in my face, litterally up in my face and said I bet I've been in the hospital more than you, and then he went off on me about Vietnam. He really scared me. I had a friend with me and in between Erick and me and said to Erick you are getting out of line. My friend's name is Jack Bramsom, his phone no. is (805)231-3415 and said if you need any questions just call him. I asked for my pump back and Erick said he couldn't give it to me. He wanted another $600. He said I gave him approval over the phone to do more work to my pump. I never did that I have work orders for everything, except this extra work he did. MY son Brian called him and Eriick tol him I came into office demanding a new cover for my spa. If I was so demanding my pump would have been fixed and put back in my spa. I have Fibromyalgia, and Arthritithis in my neck and shoulders. I am in constant pain. I explained that to Erick. He also told my son Brian, he was going to sell my pump and give me back my money, that never happened. On May 23, 2012 to see if we could make payment arrangements for the extra $600. Erick told me to call back in 20 minutes, I called and no one answered the phone, he plays mind games. I called for three weeks straight no answer. The last time Eriicks daughter answered the phone and couldn't apoligize enough. She promised she would have her Dad call me the next day, he never has called. I have and no answer! But, he did tell Bruce I could pay $100.00 a month until the $600 was paid. He said as soon as the 1st 100 was paid he have someone come put my spa backtogether. I went down to the shop and paid $100. No service guy on the job was what I was told. Erick was out sick again so Bruce was there and he said I don't know where the service person is, and because it was a holiday weekend, the servie person would not be in. My $528.00 turned into 1128.80. I could get a new spa for that much money. I was promised a new cover for my spa, by Bruce but never went in demending it. I am not a demanding person. I have called and called and no answer again. I faxed all the work orders and recipt of the $528.80 to the Coporate office and they told me they couldn't anything but hope he did the right thihg. I have tried to settle this ordeal with kindness, he is not a kind man. I still haven't heard from him. I have not paid another $100.00 because my spa was to be fixed as soon as he received the 1st $100.00. Norhing has been done and I have not heard a word from Erick. My spa has sat opened up where the motor and the pumps go for alomost two years. I am sure damage has been don due to bad weather, but I am not sure, I don't fix spas. Neither does Erik apparently. I feel he herassed me, belittled me and went he went off in my face, I am do afraid of him to go to the shop to see why he hasn't called me. When I call there is no answer, but when I went to the shop someone was there. So he knows my phone number and doesn't answer the phone. The day he picked up my pump he promised me he could fix it for the $528.80. Now a month away from it being a year he is ignoring me, not returning calls. did not have my spa fixed after I gave him the first $100.00 dollars, which he promised also.I don't know what to do, but I am not going to let him keep the $628.80 I have paid him. I can't believe he has just pushed me aside and will not answer the phone when I call. I am to afraid to go and confornt him, unless I had a police man with me. Today I am very sick and my entire body is killing me, I have an infection in my chest so I can't take the phone in until tomorrow, hopefully. Thank you for your help in this matter."

    You did not conduct this business transaction with our company. I would ask that you file your complaint against the correct company. I further would consider this irresponsible and neglegent on the part of PeopleClaim to post this defamatory accusation against our company.

1. Compensation: for all the time and work I put into trying to settle this with him, contacted corporate office and had to go fax paper work to them and he promised to make it right again, but he did nothing. Nov 22, 2012 $1,000.00
