Claimant says:
"Jonathan Lockhart owner of company met me on 11/22/13 to sign a written contract to delivery and lay 13 pallets of buffalo grass for total amount of $4510.05. I gave a deposit to him for material of $2860.00 check #2666. Per written contract grass will be delivered on Tuesday November 26th and job will be started that day. On Tuesday November 26th around 10am I contacted Jonathan because he had not shown up, he stated he was having trouble getting the buffalo grass locally and was trying to get it delivered from San Antonio. He was having trouble doing what he said he was going to do. I asked him if he could not get the buffalo grass I did have a company that could and I could get them to deliver it asap where he did not have a timeframe of when he could even get buffalo grass. We were on a time constraint from our POA to get the landscaping completed so that we could get a permnanent certificate of occupancy. We were currently residing at our new residence on a temporary certificate of occupancy. At any rate Jonathan cashed my check did not work and refused to work with me return my calls or anything. I had my husband and my builder attempt to contact him with no return calls. He has since avoided any contact with me and refused to return monies. In January I called him from a different number that he did not recongnize he answered; he was rude and his reason for doing what he did is he said I was rude and told him I was not going to pay him which was not true. He is just making thing up to justify taking someones money and doing no work. I was even nice enough to offer him $300 for him trouble and time and just return $2560. He said for me to do what ever I needed to do he did not care. Therefore I have filed complaints and I am going to start and small claims pursuit for my monies."
