Statement of Claim
Claimant says:
"Outline of the situation:

Auto Pros refused to provide me with a written estimate(Not even a hand-written) despite my repeated requests. They refused to issue a state-regulated statement. The manager of Auto Pros implied sending me a receipt in lieu, due to my persistent requests. It was instantly rejected by me. Pros only issue receipts when receiving payments. He also gave me over the phone what he claimed as a total. He, then, e-mailed me a one-line scribble which was more than the first amount he tried to give me over the phone. The amount almost gave a heart attack. All I could tell him as I was shaking, was that I must contemplate in making payments. Later on, I realized that the scribble note was sent from the manager's personal aol address. He avoided using his business e-mail address. The trust I tried to hold to maintain was yield by my new suspicion.

Then, the owner of the Auto Pros called me for the first time, introduced himself and apologized for the manager's disrespectful comment made at me on the phone. The owner expressed his willingness for resolving the issue in some amicable way. He asked me to respond to his suggestion as to in what way I wanted to resolve the issue. I replied that I would, however, there were other pending concerns in the issue that was still holding me back and three days passed.
I received a 3-day notice mail from the owner on April 4, 2016 who demanded the entire "invoiced" amount plus storage fee be paid in 3 days or he would pursuit a legal action.

This is just a brief outline of the issue.
My frustration toward the unprofessional ways of handling business at Auto Pros was simply fueled by the owner's sudden demand. I expected that the owner was somewhat more reasonably professional than the manager who claimed as a 30-year veteran. At this time, I am determined to pursuit my own rights. I also have them realize how much damage they will be causing to their newly opened repair shop, not to mention the loss of reputation and a possible suspension of their business license as a result. It is truly unfortunate that I had to seek to solve the problem in this unpleasant way. This would have been prevented easily if the owner along with the manager were in compliance with the state's basic auto repair law.

I will be posting the owner's full name as well as the manager's along with other factual information as attachment.(i.e. time frame aspects, etc.) which I did not include in this initial statement."

  • To the claimant:

Where does this dispute stand now?

Is your car still at the Auto Pro shop?

    Were the repairs ever finished?

What happened at the three-day deadline the owner set?  Did he follow through with legal action?

Have you yourself initiated any further action?

Would like to see your problem resolved fairly, but need an update.  Thanks.
