Statement of Claim
Claimant says:
"Hello, I am addressing the fact that my vehicle was illegally reposed Jan. 7, 2014. I learned that said vehicle, red 1994 Ford-150 with extend cab,VIN #1ftex15y7rkc01093 was sold 10 days after being picked up. I called the Agency several times to ask how my vehicle would be returned. I was always placed on hold and ultimately hung up on. The last conversation I had with manager, Sheila Sturman was May 2013. At the time when truck was picked up, I informed them that the truck needed a water pump, which was set to be put on Jan 10, by my mechanic, Mr. Kenney Bouie. A title pawn was obtained July 22, 2012 which included Mr. Clinton Butler and myself, Theresa Williams. We were instructed to make payments through Bank of America, this is where the account was set up. A detail bill I saw in February l was to be sent from the Agency each payment made. Never was done professionally; I had to call and request each one. This is when l noticed that inspite of making payments, the balance kept going up. During the course of this loan, the Agency has had 3 managers. This is what led me to file a small claim suit. I am a Gadsden County resident, therefore, I called Courthouse in Quincy to ask how I was to go about filing. I was told "you file suit in the county you live". I filed a claim on April 28, 2014 in Gadsden County. I was told that I needed to include managers' name and her title. Even though I would be the one calling and leaving messages for call back, Ms. Sturman would call Clinton. Even then, trying to get this information was like a bad nightmare. Again, once they knew it was me on phone, the call ended with no discussion. I made the payments, I called each time to give info; often times leaving it on voice mail. I asked my sister, Beverly Maddox to call and get the name of the manager. My sister stated, they asked me "why I was calling from Orlando"? My sister replied "because this is I live, but I'm calling on behalf of my sister, Theresa Williams". My sister called me back to say I needed to call. Well, I have been calling since January, but getting nowhere. I then, asked Clinton to call; he called me back with the information, stating that she, (I don't know if this was the receptionist or the manager), but at first Clinton said she refused to give any information; and only when he threatened her with having an attorney contact her; at this, she stated, Sheila Sturman. Clint asked her what was her position with the company? Ms. Sturman stated she was the manager. I then had to gather information on the Sheriff's office in Thomas County so they could serve the papers. The Thomas County Sheriff's office received affidavit May 2, (sent by certified mail) and signed by Shanell Roberts, The first hearing was scheduled for June 30, at 1000. The fee was $313.00; this fee included the cost of the truck, metal tag,and other miscellaneous fees paid to others to get me back and forth to school (ITT), for classes and study groups. Needless to say, with this forever on my brain plate, my courses suffered; grocery shopping, church, choir rehearsal (2 churches). There were numerous other things that were not done because of lack of a vehicle. I own a 2002 Nissan Altima, but this car was need of many repairs and I just didn't have the monies to repair. I would have driven the truck had it been there. After filing with court, and having America's Title Pawn, as mentioned, the date was set for June 30, 2014 at 0930. I received the "motion to dismiss for failure to state a cause of action and for lack of jurisdiction; this was received May 28, 2014. initial hearing date as well as An Entry Appearance from (Whitehurst, Blackburn & Warren) on June 11, 2014, the agency was represented by counsel (Whitehurst, Blackburn & Warren). Atty. Whitehurst were there for the Agency; right away he asked that the case be dismissed due to jurisdiction. Judge Garner rescheduled the hearing for August 4, but due to a conflict, Atty. Whitehurst had a conflict with scheduling so the hearing was scheduled for August 13, 2014 at 0930. It this hearing, the case was dismissed due to jurisdiction. Judge Garner asked if I had anything to say? I stated that I have all of the payment receipts. The judge then made this comment, "I have heard a lot about people losing their vehicles when all or most of the fees are paid". Atty. Whitehurst stated, "you need to talk to your legislators", and walked out of the judge's chambers. So now, I contact Georgia courthouse to determine how I and what the fee to be to file a claim. I was informed that once I filled out forms and ready for filing, I would be instructed as to which court I needed to be in; I spoke with Cristy and she advised me that she would 2 copies for each court in the event I make a mistake. I was told to fill out both forms an d when I come to file, she would let me know which form would be used. I filed 10/06/14, fee $100.00 (In The Magistrate Court of Thomas County, State of Georgia). I received notice of service dated 10/06/14 stating defendants' had 45 days from date of serving to file an answer with the Court either consenting to make payments or contest the claim. The Court will send notice of payment schedule a hearing by mail. I received Notice of Hearing October 25, 2014; a hearing to be held Thursday, November 13, 2014 at 1000. I arrived at Court at 1030, signed in and was instructed to take a seat and when the time came, we would be escorted into Courtroom. The Clerk came and asked to enter with Plaintiff on one side and Defendant on other side. The Clerk also stated, "the Judge is running a bit late, so if you want to mediate or work something out. The woman, whom I now, knew to be Ms. Sturman stated, "there's nothing to work out". The Judge entered Court, after being sworn in, he asked me, "what is it that you want to happen?" I stated I would love to get my truck back. I gave dates of all paperwork, (receipts, letters, etc.). The Judge stated his reason for asking the question was solely to see if was in the right courtroom, but if not, I could file in the Superior Court, with a fee to pay. I started with the fact that March 2014, I called America's Title Pawn to request a detail bill. I was informed at that time that I still owed over $900.00. I stated,"how can I owe that much when I'm making the monthly payments as scheduled. Ms. Sturman said, "I talked to Mr. Butler regarding this matter". I, then asked, "why are you calling Mr. Butler when I am the one calling in?" Again, I asked to receive a detail bill , from America's Title Pawn. I received 2 letters, one the detail bill and the other one making false allegations on or around April 24, 2014. One of the letters stated that "you paid $1000.00, should have paid $1244.31; $244.31 due. I called at 2315, when I got home from work. I informed Ms. Sturman that both March and April payments were made and called in. Ms. Sturman, then asked, "can you read the info on receipt; I did this. Ms. Sturman or whomever checked for payments had not done their job. I further stated "I will send $44.31 which according to you is the balance owed"? I received a call from America's Title Pawn April 25, stating that even though you pay $44.31, you still owe over $600.00. I stated that, "how is that possible?" My payments have been and I have the receipts, don't blame me if you don't check your voicemail regularly". I then told her what her letter stated. Ms. Sturman stated, "unless you pay the fees, you will not get your title back, I'll see to that"! The $44.31 was mailed May 13, 2013. The next time I heard from Agency, was January 7,2014. This is the date my truck was reposed. I showed all my receipts, but the the young lady with the group stated that, "if you never received paid in full, we have to take custody of truck. Mr. Broadway asked if the truck ran, I stated, "yes, but it needs a new water pump, otherwise it ran perfectly. Mr. Broadway stated that they will not be driving truck and their residence is in Boston, Ga. Mr. Broadway was already in truck banging on steering wheel with a hammer trying to get lock off; he asked if I had the key? I told him no. Now, back to The Magistrate Court of Thomas County, this is where I learned that my truck was sold 10 days after being picked up. Ms. Thurman, further stated that she had called me numerous times to explain what it would take to get my truck back. This never happened. I then asked where is the bill of sale? Judge Seery asked for all materials pertaining to the case and when he makes his decision, I would be notified by mail. Today is December 15, and I haven't been notified of anything. Please help me!"
