Statement of Claim
Claimant says:
"I and my family and friends have done business with this man for many years concerning the purchasing of gold and silver. i have had no problems with him and thought we had a good working relationship up to this point. Bought 2 one lb rounds of silver proofs for a large sum of money many years ago. thay have been locked up in my safe all this time. my bathroom needed remodeling so i had to turn in some of my silver to pay some bills to make this happen. the fellow i sold the silver to is a friend/business owner himself and i have done much business with him and have a good working relationship with him. with that said...the silver was sold among other pieces of my silver to a 3rd party for a good amount of money. turns out the 3rd party member tested said rounds and found out they were silver clad and not 999 silver. so he came back to my friend with a BIG PROBLEM. the 2 one lb proof silver coins were fake. the rest of the silver which i purchased from allens was o.k. again allen and i have had a good business relationship for over 2 decades. so i called him to talk to him about this problem. thinking that maybe back in the day he got a hold of some bad stuff without knowing it. i told him him what had happened and asked what he could do about it. this is an old purchase but silver is silver. so i didnt have any paper work to prove i bought it there but i didnt think it would be an issue due to the fact i buy "ALL" my silver bullion from him alone. nobody else because i dont know any one else to purchase that kind of thing from that i trust.so this isn't a new relationship. we are talking myself and my mother buying 1000's of dollars worth of gold and silver over two decades from this man. He told me he couldn't help and i didn't buy it from him. which is a lie. He said i must have bought it off the cable or internet. which is nuts. i dont buy anything of that nature without holding it in my hand for inspection first before paying. I couldn't believe it. The friend i sold this silver to was out almost $800 for these two rounds. he thought they were silver as well. he called me and told me what had happened. the thrid party person had them tested at a local coin shop and they failed. they are silver clad rounds and not .999 silver which i was lead to believe. now two mens reputations are on the line. mine and the second party member. allens has always done good buiness with us but as of lately he has been slipping with his coin depot. another friend that introduced me to him had a run in with him a few months back and because of that he is no longer doing business with him either. so somethings going on with him. all i want is a refund for the two round's but it has turned into a HUGE mess. so i am considering further legal action. theres is more to this matter for more info please call 937-515-9276 ask for mr john wagner. thank and God Bless."

  • On Friday Oct. 12, 2012 I received a call from John Wagner. He asked me if his name rang a bell and I said no, but I might recognize his face. He assured me that I would recognize him because he has purchased thousands of dollars worth of silver from me over the years. He told me that we had a BIG PROBLEM. He went on to tell me that he had purchased 2, one pound rounds from me that were not .999 fine silver. I asked when he had purchased them and if he had a receipt. He told me that he had purchased these over twenty years ago and would not be able to find a receipt. I then asked if he was sure that he bought them from me, or did he buy off the internet or TV.

    He went on to tell me that he had sold them to another dealer, who sold them to someone else who brought them back saying they were not .999 fine silver.

    When silver is purchased or sold, it has to be marked .925, sterling, or .999 fine silver. If it is not, then we don't buy or sell it.

    John states in his complain that "I don't buy anything without holding it in my hand for inspection first before paying" which is the only way to buy, especially since he says he has purchased thousands of dollars worth of silver. John's inspection would have been just that, to make sure it is silver.

    John states that he has ONLY dealt with me. But she sold them to another dealer, who then sold them to someone else.

    John states that he believes he purchased these from us over twenty years ago, "for a large sum of money." Twenty years ago, silver was below $4 an ounce.

  • hello mr. allen:) i have changed my mind about all of this. it is true i bought these rounds from u back in the day. due to the fact my mom thought mine was so neat she bought the only other one u had. u even said and i Q." these are kinda neat uwe dont get them that often." the 20 year comment was just to show that we have had a buying history with u. rory will back me up concerning this. he brought the two of us together back in the day. i think we paid u little over $300 a piece for these rounds and not four dollars.lol. u are correct one always should look at what one is purchasing but i felt at the time i could trust u concerning my silver buying and never gave it a second thought. u might have not known that these were silver clad i dont know. with that said u have to concider that i had to cover the dealer i SOLD them to so his shop would not be hurt. i am an honorable man and try to treat folks fairly. i am right when i said i only BUY my silver from u...that is true because i trusted u because of our long history. well with said that has gone out the window. i was so angery with u that Sunday that it took me to a dark place i do not care to go again. i have prayed about it and the Lord told me to let it go. u have only hurt yourself and i forgive u and i am sorry this happend at all. i am the guy that has the catalina wagon. that might tell u who i am because if im not mistaken u had one as well. anyway im dropping the whole thing. its just not worth my slavation getting so angery. i have lost over 1800 cconcerning this problem but my reputation is in tact. thank God. i do have a case if i chose to follow up on it. i have talked with my lawyer and with the long history we have at the least i have grounds for reasonable doubt. again im not going to follow up on it. u have shown me who u really are and u are not the kind a of person i care to deal with any longer and im sorry about that. selling one of my street rods for a goodly sume of money and i was going to buy more silver from u but im going to find a new dealer for that. thats a shame. again im sorry this all hashappened. the truth is the trith the rounds came from u at little over $00 a piece. one for me and one for my mom who is dismayed to say the least that there would be any "?" at all concering these coins. $600.00 total then nearly $800.00 know. good kick to the knees but the Lord will provide. peace be with you mr. allen the rounds will be sold and the money what ever they bring will be givin to the Lord. u have a good one know.
