Statement of Claim
Claimant says:
"We signed a 5 year agreement witth ADT on 05-25-07. We did not want to renew, and since it was a signed agreement, we mistakenly thought that for further services, a new note would have to be signed.
I called on 05-29-12 to find out if the contract was terminated, and found that a notice of cancellation must be filled with them. Wrote one up and faxed to them the same day.
Received a bill, and figured they had not processed the paper work.
Then mid July received a bill for $6,104.83. Called them back and finally reached a lady that said we did not apear to owe anything, and would send in a letter of despute. Asked for her name, and she would not give it to us.
We think this should be the end of this, but mid Nov. received a bill from their lawyer requesting $6225.05. Now we are closing our doors for good 12-20-2012. We dont need this agravation. What do we need to do?"

  • Do you happen to have a fax confirmation page for when you sent in the written cancellation request? If you can prove that the fax went through, it could be a potential defense in this situation. However, usually cancellation requests, when sent in, are sent in some form of certified or traceable method. That way, you have a confirmation that it was received. Going back to the fax confirmation, if you can provide that to the attorney, along with the original cancellation letter, and explain in a letter to the attorney what happened, they should be able to cancel the collection action.
