Statement of Claim
Claimant says:
"acloche will hire you on with the promise of full time or permanent employment at jobs where they are aware are not hiring full time or permanent.they get you in there under totally false pretenses,get you working your hardest trying to make the grade,just to find out that the company(in this case,TS TECH)hasn't hired on full time or permanent for years!acloche tells you in the interview that you'll work 40-42 hours a week-you work at lest 50 and it's NOT an option for temps,just for the people who've been there for years.acloche will screw up your pay,give you points you don't have coming,and when you complain about the way you are treated(because the TEMPS do the work,they get written up.the full time permanent people are NEVER disiplined by the lead.)you're told that the job will only last a little while so it's ok.they don't say anything about mandatory overtime or saturdays and when you call to complain,they say-well,you wanna work?because we don't have to place you.they told me the job would last 4 months on sept.26..they told some of us 6 months!!now we hear it ends dec.1st.some of these people have planned their finances arround this!!acloche bad faced lies to you.."

The claimant's settlement terms were rejected with the following explanation:

    "Acloche is a temporary service, and the nature of temporary work is such that assignments may change or end at any time, with or without notice, and specific guarantees regarding temporary assignments cannot and will not be given.

    At the time of hire, applicants are given basic information about Acloche and the services we offer. Specific assignment information, including pay rate and required hours, varies by worksite and is discussed in detail at the time an assignment is offered and also during assignment orientations, as applicable. Additionally, most specific assignment information is mandated by the worksite; as such, changes in pay rate, guarantees of full time hire and schedule guarantees cannot be made by Acloche.

    All placements are optional and Associates are not required to accept an assignment if the hours, pay rate or other requirements do not meet their expectations; if an assignment does not meet an Associates’ expectations after work begins, the Associate may end that assignment with notice to be placed elsewhere.

    Acloche has an open-door policy and encourages all Associates to raise any concerns with their staffing representative for discussion and resolution; if concerns are not addressed timely, Associates are encouraged to contact Acloche Human Resources.
