Statement of Claim
Claimant says:
"I had to terminate my lease with this apartment because the noise above me was unbearable. I agreed to pay the lease buy out contract. The total buy out was $738.65. I have a signed copy. I made the first payment of $200.00 and the second payment of $538.65. I did pay my last month rent per statement. After that they changed everything and started adding more fees. They changed the buy out form to re-let charges. The total amount added was $172.82 that I refused to pay. Tracy Kerr (property manager) refused to cash the last check I sent for $538.65. and turned this account over to a collection agency. I will re-issue a check in the amount of $538.65 only. I am not paying all the added charges after we both signed the original contract. Can you help me?"

  • I did ask Cedar Springs/Venterra to take me to court. They preferred to just report this to all three credit reporting agency. As I said before if you want a copy of the original contract and email from Tracy Kerr (office manager at cedar springs) I can forward a copy.

  • Maybe you should send this to Venterra Realty 38 Leek Crescent Suite 202 Richmond Hill, Ontario Canada I have sent them a copy of the signed lease buy out.

  • Yes, I agree with the Claimant. However, I believe s/he should also file a lawsuit against them. There is a similar lawsuit in District Court in San Antonio, against Venterra Realty Management. They seem to be notorious for doing this. I plan on filing a lawsuit against them myself. Also, check the Chapter 92 Texas Landlord Tenant regarding the "enjoyment of peace and quiet" of your apt, which it sounds as if they violated by not taking care of the noise upstairs, so you were not able to enjoy your apt. Take them to court, you probably will receive damages for ruining your credit.
