Statement of Claim
Claimant says:
"I entered into a lease with Mrs. Anthony on Nov. 1st 2012, with my boyfriend and 2 daughters. I gave her a security deposit of $550.00 on Oct. 27th to hold the apartment for us, til our official lease started. My boyfriend, a veteran had gotten approved for a HUD housing voucher in december 2012. After all the paperwork was completed in january 2013, i was told by Mrs. Anthony that i would not need to worry about paying her the rent b/c the HUD program will be paying her directly. I had questions about the program but she and my boyfriend simply brushed them off not answering by saying you, meaning me, have nothing to worry about. Which in its self made me worry. Months later, having domestic problems and wanting to move out, i was informed by Mrs. Anthony i was not on the lease?!? Hows that? She went on to tell me that she, my boyfriend and HUD signed another lease in January 2013, ending the original lease. Yes, and the "new" lease didn't include me. So really wanting to move now, i ask Mrs. Anthony for my deposit so i can move. She tells me if i move before the end of the lease i don't get my deposit back. First the lease that i gave her the deposit for, she said is ended. Second i am not on the "new" lease. Third i wasn't notified of the original lease being replaced or ending and that i wasn't on a lease with her anymore. The law states that all parties must be informed and in agreeance of lease changes as it is a legally binding lease and document. I was not. So i ask her then what about my deposit? She, Mrs. Anthony informed me she applied my money to my boyfriends lease, again which i wasn't included on. No one asked me if my deposit money could be transfered or used for another lease, mainly b/c i didn't know about this new lease for months later. I simply want my deposit that i gave Mrs. Anthony, for the lease i signed with her after i fulfill my year long agreement with her, Nov. 1st 2013. Thank You for taking the time to listen to my civil issue. Basically she did not ask my boyfriend for a deposit on the new lease and does not have a deposit for that lease and is holding my money."
