Statement of Claim
Claimant says:
"WHEN I PICKED UP THE CAR IT WOULD NOT START AND AFTER TWO DAYS THE BRAKES WOULD NOT THE CAR, I HAVE NOTIFIED THE STATE OF NC AND THEY TOLD ME TO BRING IT TO SMALL CLAIMS COURT, I PAID $3969.88 TO FOLGERS AUTOMOTIVE AND THE BRAKES FAILED TWO DAYS LATER, BROUGHT IT BACK AND THEY FOUND NOTHING WRONG, I HAVE BEEN DOING CARS SINCE I WAS 12 YEARS OLD AND CHANGED BRAKES MANY TIMES WITH NO COME-BACKS LIKE THIS. CAN YOU HELP ME PLEASE BECAUSE I HAD TO TRADE THE CAR IN TO GET A NEW KIA WHICH HAD NO PROBLEMS."

  • I HAVE BEEN DOING CARS/TRUCKS SINCE Y WAS 12 YEARS OLD,THE MASTER CYLINDER WOULD FAIL RIGHT AWAY NOT 4 MONTHS LATER AND WHEN THE CAR WAS DINE IT WOULD NOT START AND THE BRAKES FAILED TWO DAYS LATER WHEN I BROUGHT IT BACK THEY COULD FIND NOTHING SO I HAD TO TRADE THE CAR IN BECAUSE THE BRAKES FAILED AGAIN,THIS IS NO WAY TO RUN A BUSINESS.

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • "This letter is in reference to the claim Mr. Natelli from visiting our shop on 11/27/13.
    Mr. Natelli brought his vehicle into the shop with the complaint that he had replaced the brake pads and his brakes now felt soft. We dispatched the vehicle to one of our KIA factory trained techs to perform diagnoses. The tech found that the master cylinder seals where leaking due to the customer not bleeding the pressure from the brakes when he replaced his brake pads. This caused damaged to the master cylinder internal seals causing the brakes to feel soft. We informed the customer of the failure and he approved the repairs to be performed while he waited. Our KIA tech performed the repairs and test drove the vehicle and the braking system was working as designed after the work was performed. The customer never returned or did he inform us that the vehicle was not operating properly after the repairs where performed. KIA offers a 12 month 12,000 mile warranty on all parts replaced at a KIA service center.
