Statement of Claim
Claimant says:
"I have had a commercial account with Waste Connections for approximately 5 years. Due to the economic decline and downturn in business while operating at a substantial loss, I have been forced to seek employment elsewhere and have for all intensive purposes all but shut down my business. In July of 2011, May of 2012 and November of 2013 I had made verbal request to cancel services with no response. In December of 2013 Waste Connections informed me that I was required to document in writing my desire to terminate services which I had more so adamantly been trying to terminate since November of 2013 by verbal communication and writing on the November billing to cancel.
On December 17th. 2013 I faxed a letter with the correct address and fax number addressed to Waste Management instead of Waste Connections to cancel services as instructed to do so.
Waste Connections acknowledged receiving the transmittal.
A verbal agreement to cancel services in May of 2012 with Commercial salesman "Jeff" was also previously discussed and agreed upon. It was expressed that I no longer wanted to be obligated to a contractual agreement but would continue services based on a month to month service and the ability to downsize to a smaller container at my discretion.
Unfortunately I did not get anything in writing as I felt I was dealing with a reputable company and a representative with integrity who I could trust to honor his word.
As of this date March 12, 2014 a Waste Connections trash receptacle remains on my property without being touched and has had illegal dumping from unauthorized users since November of 2013.
They continue to send me threatening certified mail and continuous statements stating I owe liquidated damages in the amount of $ 557.17 plus any past due sums due to an alleged contractual agreement through January27, 2016.
I ask again to reflect upon the totality of the economic circumstances and my repeated past efforts to cancel this service by honoring the verbal agreement made between myself and commercial sales representative “Jeff” dated back to May 12th 2012 and two other attempts to cancel.
Also please clarify how Waste Connections could possibly hold me accountable for an extended contract extending to January of 2016.
I would think after reviewing this past history Waste Connections would show that they are a reputable company and correct this situation by withdrawing all demands of additional payment, removing their receptacle from my property and the dismissal of this fraudulent contract which I have been trying to cancel since July of 2011. This account was paid in full through December 1st. 2013 and has not ben serviced since.
