Statement of Claim
Claimant says:
"I am disabled with a visibly identified highly trained service dog. I suffer from PTSD.

I visited this location Sunday the 14th month of September 2014 at approx. 3.am. Thinking I was avoiding any confrontation dodging any stressful midday crowds, and my anxiety concerns, I decided that 3 a.m was the best time to venture out. Although I was successful on avoiding any unruly, rude or loud customers or simply just a crowded store, I was indeed greeted with an apparent physical threat that my dog alerted me on, of an EXTREAMLY loud buffing machine that was powered on with less than a foot before approaching quickly to my dog at the top of an aisle. I looked IMMEDIATLY over towards the man behind the mayhem in shock and utter disbelief in his actions and he yelled to me "What!!??" over the machine, and practically over top of his voice I yelled "WATCH WHERE YOU'RE GOING WITH THAT THING!!!" He screamed back "FUCK YOU!!" I stood their with a clenched fist, and devoted companion beside me keeping me calm, while that old man who I refuse to label with ANY kooth, much less a gentleman, told me to "SUCK HIS DICK". I at that time walked directly over to what i have since found out is to be the active night time store manager named Jeff, LITERALLY 15 feet from said confrontation, if he heard what had just inspired some 15 feet in a direct aisle line behind him with no isles to interfere with sight or sound (besides the machine) and his exact response was "no". As he continued to donate his very uneducated, blank stare to my situation in description he then said "huh, sorry you went through that." I had at that time told him to handle it or I will. I shopped anxiously for 45 minutes and before leaving after pending $200.00, I requested to speak with Jeff, he approached me, and I asked him, "How did it go?" he asked stupidly in response "what do you mean?" I said, "the incident I brought to your attention" he said "Oh, I haven't had a minute to talk to him to see what happen yet". I said "I TOLD YOU WHAT HAPPENED"!! It was at that time that I realized why that rude employee felt so comfortable in displaying such incompetent behavior. His boss was no better.."

  • To whom it may concern:
    To add, I suffer from stress related seizures. After being cautious of my surroundings, I had been seizure free for 5 months. That night I had two physician documented seizures. I expect for walmart to except FULL responsibility, or not only will I be going public and to the media with my experience, but also to the courts, if needed.

  • It has been almost 5 months and still no response. It is evident that Walmart does NOT care about the policy's placed to prevent such incidents.
