Statement of Claim
Claimant says:
"April 17, 2016. Marty was contacted about the job.

April 18, 2016. Marty came over and looked at the house and shop which is a large job. Marty said he'd been a paint contractor for years, had a license and could show us many happy customers. We made a verbal agreement, with written agreement to follow. Marty said he needed the work and would give me the friends and family price, with the materials and paint at his cost. (I had been told to watch Marty as he would drink on the job, but does good work.) Also my son and I would be his helpers, but Marty wanted April (last name ?) to mask and tape as she was a union painter and would do a good job. Marty added that if we, my son and I, did the masking and taping we could mess up the entire job. I said we wanted to have mother's day at the house, so could at least have the kitchen and dinning room/dean done in time? No problem. Marty would get us a quote for the interior and exterior of the house and shop. I agreed. Marty said the first step was to order the paint, I agreed.

Marty then continued to want Dave hired for something. I said I thought that we agreed we were enough painters to do the job. Marty mentioned that Dave could pressure wash the roof, so Dave jumped in and added that the shop needed repair and prep for painting. I told Dave to give me a number. Dave offered, same as Marty, to get the materials at his cost. Dave came back and had the material cost, I ask, what about total cost for the job, and just like Marty, I'll bring that tomorrow. We also selected paint colors.

Marty said they could not be there on April 19 as they were finishing a roof job, but would be back on the 20th, I agreed.

April 20th They couldn't make it to my job as the roof job had run into problems as the owner of that job messed the whole job up as the owner moved the plastic cover on the roof and got water in the house and was blaming Marty and Dave. Marty and Dave said the guy was really a problem.

April 22, Marty and Dave came by but said they had to leave as the roof job went bad again. I ask did you order the paint? Oh, yes, we ordered it. Marty I'll bring it tomorrow. Oh, I forgot you never told us what colors. So we gave him the same numbers and names off the samples.(That tomorrow never came.)

April 23, NO SHOW.

April 24, Marty came in with an invoice $2,099.13. I ask where's the paint. Well, there was a mistake with the bank, I'll get them straighten them out, but I need cash. OK, I went and got the cash, paid him with family members present. Later that day Marty and Dave brought 4, 5 gallon buckets of outside of paint @ $132.93 each and some plastic, tape and paper. I ask where the rest was? Marty said he would bring it tomorrow. Tomorrow never came. Marty and Dave said they had to go to Montana, but would be back to start the kitchen. * As we found out later 3 of the 4-5 gal. of paint were the wrong color and they were exterior paint anyway.

May 7, Marty contacted my daughter-in-law on the night before Mother's day and ask her if he could paint on Mother's Day. She said no. I was not happy with Marty, another agreement broken.

Not sure what date, but Marty and Dave came back to my house when I was not present and took back the paint, 4-5 gal. buckets of paint, to fix the color because they claimed my daughter-in-law messed up the order, we have a text proving him wrong. Plus, my entire family was present on two other occasions when Marty I do not have the dates but my daughter-in-law has text asking Marty for a quote. Marty and Dave played a little game with us, once I started applying pressure for my paint. The game was when I said I want this, they would contact my daughter-in-law, my son or me and blame the problem on the other person. Thank God we did not play that game.

Once things went down hill, (please read email attachment) Marty said he was out of this I said no. Dave started harassing me as according to him he was the contractor. I will submit documents that support dates, cost and that Dave was in fact acting as the contractor. The Rodda paint invoice was purchased by UCCM, Dave's company. The shop materials from Parr lumber says Tacoma Contractor.

Subject: PCSO incident number, 16-137-00671, Deputy Collins #389
Today at about 11:47 AM, at my home, 1815 290th St E Roy WA 98580, Martin (Marty) Lee Guy with his friend Dave Reusser showed up at the house, Marty was drunk again, to do an ongoing painting job.
Background:
I hired Marty to paint, but not Dave, that started a month ago, April 18, 2016. Marty represented himself as a painting contractor. I was told by others that Marty did a good job at a cheap price, but watch Marty on a ladder as he is often drinks on the job. Marty said he needed the work and would do my job for the friends and family price with materials at his cost. After a month, and about $2,100 for paint, I have about 40 square feet of my kitchen painted, but not one brush stroke by Marty or Dave. Marty has only worked a couple of hours on this job the entire time. Dave did not always show up with Marty. Marty and/or Dave showed up maybe 8-10 times, for an hour or so and then have to leave for some important reason. Marty and Dave were at the house, (once) worked for a couple of hours, but went to lunch for 2 ½ hours and came back drunk, more lunch and alcohol than work. Marty ALWAYS had alcohol on his breath. Marty and I have had words about this several times, as I couldn’t have him or Dave on a ladder. I did not hire Dave to paint, but both Marty and Dave pressured me into hiring Dave to pressure wash the roof and repair and prep the shop, which was not done. Marty talked me into hiring April, last name unknown, a union painter to tape and mask the job. That work is about 40% complete. Marty ask me to pay her cash each day as she needed the money immediately to feed her kids. On this very morning April had shown up about 10:30 am. I complained about no paint, no work being done. April volunteered the information that this is normal for Dave and Marty. I said “this is beginning to look like fraud.” April said “I have seen them do this to others” I said “you mean they aren’t going to do the job?” April said “I have seen them scam people before, yeah, take their and they are gone.” Then I said “if they have no intention to do the job and keep my money then that’s fraud----then they will go to jail.” April said I don’t think they will finish it.”
Narrative:
When Marty and Dave showed up I met them in the driveway. Marty was drunk as always, and unloading a ladder. Dave never got out of the truck so I don’t know his condition, but has smelled of alcohol in the past. I say Marty was drunk because his eyes were blood shot red and the smell of alcohol was very strong at the distance of three feet.
I ask Marty “what do you have planned to do today?” Marty said “we are going to paint.” I ask Marty “What are you going to paint?” Marty laughed and said “the house.” I said “Marty with what, you didn’t give me all the paint, and then you came and took what you had brought and then removed it without my knowledge, so what are you going to paint with?” I continued “Marty go get the paint I paid you $2,100 for a month ago”. I said “I don’t want you guys to spend the next couple days or even hours here with no paint or materials, this is has been going on for weeks”. Marty said “are you irritated with me?” I said “yes”. Marty got upset and started to accuse me of the problems, saying “it’s your fault, you haven’t taped and mask the job and you cancelled the paint order”. I said “this is my fault, we have talked about this before Marty”, “then why am I paying April to tape and mask and I never changed any paint order?” Marty got very agitated and stepped toward me. I backed up. I said “Marty you have 48 hours to get the paint here and give me a plan and cost.” Marty then said “you owe me another $1,100 bucks for the paint, you only paid half the bill.” (If factual, then it would have been an additional $2,100) I said “I still have the invoice” Marty said “that was my (his) price, you owe me double that” I put my index finger up and said “No, I paid, you gave me the invoice, as agreed.” I said “no, you told me the price, I paid it and everything has been good for a month on that, except I don’t have any paint.” That sent Marty off to yelling and coming at me, I again backed up. Marty yelled “don’t you yell at me and shove your finger in my face” I said “I didn’t do that” (I did not shove my finger in his face, I was moving backwards.) I said “Marty you have 48 hours to go get the paint and then we will talk about what will happen with this job, I need a plan and the cost” Marty yelled at me, with both hands in the air, palms facing him making the gesture to come to him, saying, come on fucker, we’re both men, come on face me like a man.” I said “no, get the hell off my property you have 48 hours to bring the paint.” He yelled that he was going to take his equipment and never come back to this fucking place Marty now out of control came at me, I turned my back to him and started to hurry to the house. I feared Marty was going to assault me at that time, so I started to retreat to the house. Marty “yelled this is illegal” I said “I am calling the Sherriff, he can decide what to do, just get off my property” Marty refused to leave. Marty kept coming. I went in the house, closed the door and called 911 as I was sure Marty was going to assault me. My door was closed. First April entered my house and said I just want our tools. I said OK, I don’t want that stuff. Marty then entered the house while I yelled not to. I did yell then, 911 heard that exchange. All three remained for a couple of minutes, with April leaving first.
The Deputies arrived some 10-15 minutes later. I told the Deputies I still had the machine, which I don’t want, but for fear of assault and the machine was in the house, I still have the machine. The Deputies felt I was on “OK” ground at this time, but told me to resolve the machine issue. I agreed.
May 16-17, 2016. Marty and Dave both called and text about 10 times with accusations, name calling and more misinformation, until 9:53 pm and started in again at 6:45 am. After several text and calls repeatedly told them to stop contacting me with what I considered to be harassment. *The really important information here is that Marty expressed that Dave was the contractor, not him. Marty contended that Dave was the contractor, not him, he’s (Marty) is out of it and Dave started harassing me for money he now says I owe him as the contractor. Dave supported that by stating a couple of times in a text that it was under his contractor’s license the purchases of material were made.
May 17, 2016. Arrangements were made by my son to get the washer back to them in a public place to avoid any physical assault. Marty did agree, but failed to respond.
May 18, 2016. My son Todd, his wife Christine and step son Ryan went to deliver the machine. I did not go as I was afraid I would once again be the issue. Marty did not show, he sent Dave instead. That did not go well with an actual assault on my son and his wife. Refer to PCSO incident number 16-139-00608, Deputy B. Coburn #327.
May 18, 2016 Today, I was told that both Marty and Dave have lost their driver license for DUII, but yet I have seen both drive motor vehicles on public roads. Marty is not a contractor. Dave is the contractor with no business license. I don’t know this is a fact, but Dave is under some DUII/injury accident AA supervision and cannot be caught drinking or either of them even driving sober? It turns out, as I am told, that April isn’t a union painter and is Marty’s current girlfriend, not confirmed. April is supposedly a licensed real estate agent.
I was also told today that Marty does have several business licenses, but is not a contractor. Dave had a contractor’s license but lost it in 2014 I am told. So basically neither Marty nor Dave can act as contractors as of now.
* I have just learned that Marty and Dave NEVER bought the paint listed on the invoice, except the 4-5 gal buckets, 3 of which are the wrong color. Marty and Dave used my money for a trip to California, not Montana. Why lie about the destination? The trip had to do with moving an ex-girlfriends property to a storage unit with JUST Marty's name on it. Why do I mention this? It's a good example of Marty and Dave's dealings, it seems everything is a lie and a scam.
