Statement of Claim
Claimant says:
"BMy daughter Beverly and I (Elizabeth) went looking for a reclining sofa and a wall hugger recliner chair starting in December of 2012. We looked at Hudson’s, Ashley’s, Days and Badcock furniture stores. We did also go to Tarpon Furniture in Hudson, Florida after seeing an ad in the paper. At that time we saw a Westside wall hugger recliner that we liked in the store after we tried the chairs they had. Melinda Poirier was the salesperson who helped us. We then decided to go back and buy the sofa elsewhere. We could not find a wall hugger that fit us at other stores.
In January 2014, we looked all over again. On January 16th, 2014, we went back to Tarpon Furniture to try again. Melinda Poirier, who was our salesperson, again helped us. We told her the first time and again this second time that we needed a wall hugger recliner with a handle on the side. We repeated this several times as we looked and tried out each chair. We also told her we wanted genuine leather. We tried the peach colored chair by Southern Motion. Melinda said “that they do not stock chairs because it cost too much to inventory. But, they could get it from the manufacturer in any color we wanted. The delivery would take 4-6 weeks. The manufacturer, Southern Motion makes the chairs and builds it for us as soon as it is requested”. Melinda checked her books and with another employee for the color samples and to make sure the chair came with the handle on the side. Melinda said that it did and the female employee said that the Southern Motion rockers and wall huggers all come with a handle on the side. We asked for a handle every time we tried a chair. Melinda also asked for half the money down for deposit. Beverly and I each paid $192.50 each on our credit cards ($385.00). We would not have bought this #2150 Southern Motion, wall hugger recliner if it did not have the handle on the side.
We then waited and I called to see where the chair was. I was told that there was a delay due to the weather in Mississippi, where they make the furniture. I waited and called again and was told it was on the truck to Florida. I called again and was told it would be delivered to Tarpon Furniture on Tuesday or Thursday and to us on Saturday. The chair was delivered Friday, March 7th, 2014.
When the two men on the delivery truck came in with the chair and sat it down the chair rocked slightly. I could see the rocker frame. I told them it was not the stationery wall hugger recliner we wanted or requested, it would have to go back. They driver then called the office and talked to someone. The driver said they would leave the chair so that we would have a chair to sit on. Then he left. We then received a call from the office. They told me they would not leave the (wrong #1150 chair) unless I paid the balance on the chair while we waited on the correct chair to come. I told them NO – come and get the chair.
On Saturday, March 8th, 2014 we went into the store to see Melinda and make sure the shipment did not get goofed up again. We again sat down with Melinda, Beverly, my 2 Grandchildren and myself to hopefully get the correct chair this time. Melinda, said that she got the wrong (#1150) number when she looked the chair up in the books. She said that they would pick up the wrong chair at no cost and correct the number to #2150. Again, it would take 4 to 6 weeks for delivery of the correct chair. We again asked #2150 if this chair came (wall hugger recliner) with a handle on the side. We were again told by Melinda that YES, all the rockers and wall huggers come with a handle. Bruce Weintraub, owner of Tarpon Furniture and Spring Hill Furniture Inc said “to put the wrong chair #1150 on the floor to sell”.
On April 24th/25th, I called to see when the correct chair #2150 would be delivered. I was told that the truck had taken the chair to the wrong warehouse and they would have to pick it up. The chair #2150 (without handle) was delivered on April 28th 2014. The drivers brought the chair in and placed it for me. The drivers did a good job and were polite. The driver stayed inside with me while the other man went back into the truck. The driver asked me to call the office to finish paying for the chair $384.33 on my Visa card. He sat in the chair and put the feet up and lay back in the chair while I was on the phone. He said “they had another delivery before us of the same color of furniture and they were a good seller”. I did not see the other side of the chair; it was turned away from me. He put the chair down and had to go, took the paperwork and left.
I sat down in the chair after he left. I tried to put the chair open and recline. I could not find the handle on the side of the chair. I then tried to push open the chair to no avail. I tried again and my right hand hit something hard down inside the chair. I reached down inside and there was a pull handle with a string to open the chair. I had to pull hard to open it. I went outside to see if I could catch the truck but it had left by the time I went outside.
When I told Beverly what happened. My daughter came inside and tried the chair too, she said it hit her in the wrong place and hurt her back. We changed our clothes and went to the store April 28th, that afternoon. I called Melinda and told her it was the wrong chair. Melinda said “she never remembered that conversations, the chair comes that way, they do not do returns and I am stuck with it.” When we walked into the store Melinda and another blonde lady were waiting. We all sat down and talked. Melinda again said “she does not remember the conversations about the handle on the side.” The blonde lady said “rockers and wall huggers come with handles.” When she found out that the chair in question was a wall hugger – she shut up. Melinda said they would not return the chair. They both told us that the #1150 (first chair) we returned that they put on the floor had sold. We cannot believe Melinda does not remember the many times we specified a handle on the side of the chair. Melinda is flat out telling a lie. We want our money back and nothing to do with Tarpon Furniture. They kept arguing with us and we left.
We left the store and came home. Later that afternoon April 28th, I called the store and asked for the owner Bruce Weintraub. I had to call him three times before I was able to talk to him. He told me that he had been in business for 30 years and he always tried to make his customers happy. I explained “to him that it was the wrong chair, without a handle.” He said “that is the way the chair comes.” I said “that it does not have the same height back as the peach chair on display.” He explained to me again how the chair must be broken in. I knew about this before. He wanted me to measure the chair and he would do the same to the peach chair on display. I was to call him on April 29th after 10:00am with the measurements. He said “Melinda does not remember the conversations about the handle on the side. That I say I did tell her and she says does not remember. That he is in the middle.” I explained “that Melinda had checked the books and with someone else and they said that rockers and wall huggers come with handles”. Bruce said “he does not do refunds”. I agreed to call him on the 29th the next day. I wanted to do some research on him.
The next day April 29th, I called Bruce back. It took several calls back; I had to leave a message for him to call me back. Bruce called me. We again repeated the conversation we had on the 28th several times. He said that he would be willing to give me a power as it only cost him $50.00. I said NO, I do not want power. I only wanted the handle on the side. I told him that I wanted him to pick up the chair and give me a full refund. Bruce said “he does not do refunds”. I asked him why he does not do refunds. He could not give me a reason. He would not refund my money back to me. He again went back over the whole previous conversation. He again refused to give to use a refund. I then told him that I had gone to the bank and we had disputed the charges on the credit card (Visa). He said “do you know how this works?” You dispute to Visa, they send me the notice, I send the copies of the paperwork and you can dispute again and I will do the same for as long as you want and at the end all you will have is the chair”. Yes, I know how the dispute works. I told him again I wanted the chair picked up and a refund. I also “told him I wanted nothing to do with him or his company because of how they do business.” I feel they are dishonest and lie, anything to make money. They do not care if they hurt people.
I wound up in the ER with blood pressure 216/114. The doctor tried to bring it down with medication. When I left it was 212/80. I am 76 years old and I do not need this. This was in the afternoon of the 29th of April. Thank you Bruce Weintraub, owner of Tarpon Furniture and employees.
If you go online to check out the owner and his company. You will find a multitude of complaints about them. He has or had several companies’ complaints and lawsuits: BBB West Florida, People Claim, Yelp, Pasco County Civil Court, and division of Consumer Services. Companies listed Bruce D. Weintraub, Tarpon furniture, West Coast Furniture, Spring Hill Furniture Corporation.
We checked Tarpon Furniture web site, the Southern Motion chairs were all on display. The chair #2150 was included and it showed a handle on the side. Also, Southern Motion site, J&J Site, Hudson’s site, Wolf’s site all showed the handle on the side. I am sure that we could find more disputes. This man needs to be put out of business; he should not be allowed to prey on the Public."

  • Mrs. Van Zyl was delivered the chair that she picked out. We are a special order store, Mrs. Van Zyl signed the invoice that clearly states" Cancellation of special orders or floor models forfeits deposits unless otherwise stated. Mr. Weintraub offered Mrs. Van Zyl to make her chair power, he did not say he would charge her for it. He gave her five different options to make this situation better. Mrs. Van Zyl refused every one. The pictures in the catalog do not show handles. Handles were never even discussed. Most modern recliners have inside handles. On a cable, not on a string as Mrs. Van Zyl stated. I truly feel this is a case of buyers remorse, and Mrs. Van Zyl is looking for a way out. She stated herself how long she was looking for her new furniture. Since 2012. That is quite along time to research furniture. We apologize for any inconvienence, but we have tried to rectify this and Mrs. Van Zyl will not budge.

  • May 19, 2014, Claiming party added:
  • A(Bruce D. Weintraub) Owner, you have damaged your own reputation by your business tactics. Anyone can go online and research you and your businesses and find you have been dishonest. The Pasco County Civil Court Lawsuits and complaints are online to see from 1991 until 2014. Under Bruce Weintraub, Tarpon Furniture, Spring Hill Furniture Corporation, West Coast Furniture, Sarasota Leather Gallery, Inc, Villages Leather Gallery, Inc., and Family Furniture Showrooms. You may also look under Pasco, Pinellas, Sumter, Citrus counties. I am sure there is more information out there on you.
You first sent into Southern Motion (manufacturer for #1150 chair that took approx. 7 weeks for delivery. When delivered it was a rocker recliner w/handle on side. The chair was supposed to be a stationary wall hugger recliner w/handle on side. You (Melinda) salesperson admitted she had looked up in the book and got the wrong number. It should have been #2150 chair instead. “We asked her again if it had a handle on side. (Melinda) salesgirl checked it out and said “all rockers and wall huggers have a handle on the side”. She goofed the first time. Your truck picked up the first wrong chair. (Melinda) salesgirl then sent to Southern Motion for the second #2150 chair.
In approx. 7 weeks the second chair #2150 was delivered. WRONG CHAIR AGAIN, THIS CHAIR DID NOT HAVE A HANDLE ON THE SIDE!! I did not know this until it was too late to catch the truck. The driver had sat in the chair and reclined it while I was talking to his office for credit card information. The chair was sitting at an angle and I could not see the other side. When I hung up he then got up to give me the invoice said “the office will send me the card ticket to sign and return.” He walked out the door and left. I then sat in the chair, reached for the handle and there was none, it would not push back either. I felt something on the inside of the chair poking me in the hip, it hurt and was hard. I tried to push it down then pulled it up, the chair finally opened up. A pull with a string attached to open the chair. I never heard of such a thing. My daughter came in and sat in the chair said “it hurt her back”. She did not like the chair either; the pull poked her in the hip too.
We then went to the store “Tarpon Furniture” meet by the (Melinda) salesgirl and another salesgirl. We all sat down and discussed the #2150 chair. The other salesgirl said “ALL ROCKERS AND WALLHUGGERS HAVE A HANDLE ON THE SIDE.” When she found out the chair was a wall hugger that was delivered without the handle she shut up. Our salesgirl (Melinda) said “she did not remember any conversation that we wanted a handle on the side of the chair.” It was clear she was lying to us. (We had looked at many chairs thru out the store and asked if that chair came w/handle each time.) We know very well that she just did not want to admit she goofed for the second time. The salesgirl (Melinda) said “no returns or refunds”. The conversations turned to rudeness and arguing so we left. I had told her “to pick up the wrong chair for the second time and refund the money” she refused. This is deceptive sales tactics, dishonest, lying, misleading, taking advantage of customers, even the senior citizens.
When you go online to “Tarpon Furniture Website” under Southern Motion it shows all their chairs including #2150 w/handle on the side. Also, Southern Motion site the #2150 handle is on the side. Many other sites also show the handle on the side #2150. Now you say “it does not come w/handle only pull string.” Something is wrong here! There is a misrepresentation of the merchandise, it was not the chair we were told it would be or wanted. The salesgirl (Melinda) goofed again and made a mistake or was it on purpose? Owner, (Bruce), the only honest thing for you can do is to pick up the chair and refund the money. You can put the chair back on the floor and sell it like you did the first goofed up chair #1150.
Owner (Bruce), you only offered another chair in the store of same value or a power chair. You said “it would only cost you $50.00 and you would go for that,” I said “we had tried the chairs in your store – none fit us” and “I did not want a power chair.” This made you mad. You became rude and said “you do not do refunds.” I asked you why – you did not have an answer.
The chair is the wrong chair, your web site and Southern Motion show #2150 w/handle. Please pick up the chair and refund the full amount of money back to us. Your business record speaks for itself. (Bruce) owner, you have been sued in several counties in the state of Florida. You are a deceitful person. We want nothing to do with you, your employees or businesses.

  • Mr. Weintraub, it appears that you cannot tell the truth. You and your employees never stated anything about a "special order store" , in your store or your web site. I did not sign any invoice that stated same. Your salesgirl Melinda said nothing about special orders, she only said that you did not stock the chairs in inventory because it was too expensive. WE ,my daughter and I both told Melinda we wanted a handle on the side of the chair as we looked thru all of your chairs. Now she says she cannot remember, she is lying and you know it. You only made two offers, 1. to find another chair in the store; 2. to give me power. We did not want either one. You keep changing your story. One reply you said that the chair doesnot come with a handle. I have pictures from your website, Southern Motion, and 5 others showing the chair with a handle. Never once since we have looked for furniture did we ever find a chair with a pull cable to recline a chair. We started looking for a sofa and chair December 2013 and continued into 2014. This is a case of deceptive business tactics.

  • May 22, 2014, Claiming party added:
  • As anyone can see on the picture of the chair it has a handle on the side of the chair. You stated that our chair does not come with a handle on the side. Two of your employees stated that WALLHUGGERS AND ROCKERS does come with a handle on the side. We told the salesgirl several times over that we want a handle and she knew this. Both of you knew this did not come with a handle. THIS IS CALLED FRAUD!! THIS IS ALSO CALLED MISREPUTATION!! Remember WE DID TELL EVERYONE THAT WE WANTED THE CHAIR WITH A HANDLE ON THE SIDE. YOU GAVE US ONE WITHOUT. Also, on your site, all your chairs has handles on the side. It does not say anywhere that a model does not come without a handle. EXPLAIN???

  • May 22, 2014, Claiming party added:
  • We received a call from Southern Motion today. I missed the call. I need to call him back later today. Now, you are telling someone else to do your dirty stuff. As anyone can tell with the information that I have and YES I DO HAVE MUCH MORE TO SHARE! This is not the chair that we ordered. Just be honest and return all our money. Come pick up your chair. We find several places that this chair does come with a handle on the side in several sites.

  • May 22, 2014, Claiming party added:
  • I just wanted to put this one out there so everyone can read how dishonest this person is. You can read he has two last names. One is Wine and the other one is Weintraub. Same person, same owner. Why does he have two last names? Makes you wonder how honest he is!

  • Elizabeth called Dion Thorton who is a Representive of Southern Motion. (941)914-6278. Elizabeth told him that she was very mad about what is going on with Tarpon Furniture. She told him that she does not want anything to do with him or the Tarpon Furniture. The reason Dion called is the owner asked him too. Elizabeth told him everything. What the salesgirl told us, the websites does states the chair have handle on it, his lawsuits that he had, the fraud that he did to us, and more. She told him to tell the owner that we want our money back and take the chair. That is the only honest thing he can do. Dion was very nice as well as mom. We just want this to be end now. Just return our money. I keep finding things about him. I have to call two more place to get copies of lawsuits that he was in. Sad thing is Bruce thinks this is all a joke. But, it is not. We have many people are backing us up with this.

  • Jun 18, 2014, Tarpon Furniture (responding party) added:
  • This entire incident is the result of buyers remorse. Although the chair has nothing wrong with it and is in perfect condition, it is only manufactured one way from Southern Motion. She insists that they make it with a handle on the side on a wall hugger. We explained it does not come this way, the factory sales manager spoke to her and explained it does not come this way, but yet Mrs. Van Zyl wants to reinvent the wheel and claims otherwise. The next thing that Mrs. Van Zyl will complain about is that she bought a cadilac and it doesn't run on solar energy attached to the top of the car.
As a thirty year successful business we bend over to make the customer happy. If the consumer is a miserable person and not happy with thier own life we cannot change them. Mrs. Van Zyl fails to mention that we offered her any other chair of her choice at no extra charge regardless of the price of the chair. I offered her a $2000.00 chair at no extra charge to put her to rest but this did not even make her happy. She would rather spend her entire life defaming us. The bottom line is we like every other store can not warranty customer remorse. We beg Mrs. Van Zyl to get a life and complain about another product she owns. If anybody wants to be diligent enough to dig they will probably find that Mrs. Van Zyl has a problem with several businesses.

  • Jun 19, 2014, Tarpon Furniture (responding party) added:
  • Mrs. Van Zyl has stated several times that she was never told about special orders and the refund policy. Please note the SIGNED sales and credit slips attached, that SHE signed. They both state Cancellations forfeits deposits,All sales final.

  • Jul 11, 2014, Claiming party added:
  • Mr. Bruce W.

Yes, I do wish to respond. However, I am not sure how to address the owner as he uses two sir names Bruce Wine and Bruce Winetraub.

As you are well aware your own website as well as several others shows the chair with a handle. And you also know that Melinda Poirier your employee sold the chair and made a mistake on the first chair # from the catalog. The wrong chair was delivered and refused. You returned the chair and she again sent in paperwork to Southern Motion after looking in the catalog again. Each time we were in the store we asked for a stationary wall hugger recliner with a handle on the side. We did not want a power chair, button on the side or a push to open on the side. We were told by your employees that “all rockers and wall huggers come with a handle on the side.” We checked out other chairs in your store, we did not like any of them.
Yes, you did offer two options, another chair in the store or put a motor for power on this chair. It would only cost you $50.00 and you would do that. I thanked you for the offer, but declined. The second chair was not what we stated to Melinda nor was it what we were told it would be. Plain and simple.
Every time you respond to a complaint you go off on another excuse. Either it is another mistake made by Melinda or your employees knew that the chair did not come the way they said “all rockers and wall huggers come with a handle on the side”. On May 22nd I received a call from Dion Thorton, Sales Rep for Southern Motion in Florida. I had to return his call on May 24th. He explained to me that the undercarriage of the chair was made by Leggett and Platt and did not come with a handle. This is very upsetting either it was a mistake or you sold the chair knowing it was not made with a handle on purpose. In either case Mr. Bruce the honest thing to do is take the chair back and refund the money. You put the first chair on the floor and sold it. This one you can too. It has never been used. We have never sat in the chair. It has a sheet over it.
We have sent our backup included into the complaints also, showing the chair with a handle on your website as well as many others. Complaints against you and the court cases filed against you from the 1990’s until 2014. This does not show a very good pattern of business practices.

On April 29th, I explained to you personally and in each complaint that we do not like or want the chair – it does not have a handle on the side. On May 22nd, you asked the Sales Rep from Southern Motion to call me and state the chair is not made with a handle only a string pull. I have never heard or seen such a thing. We as many other customers of yours feel ripped off – you only care about the money you dishonestly steal from us. Go look online for yourself and see.
As for the Credit Card Company, they are still investigating our complaint. You have not received a verdict as yet. You should be ashamed of yourself.
