Claimant says:
"In August of 2011 we had Superior Asphalt seal coat our driveway. As part of the job, the cracks were supposed to be filled. The workmanship of the job was poor, the cracks were not filled and the seal coating was uneven. We immediately called and left a message voicing our concerns. We received a phone message back and were asked to send pictures. We called again and requested that someone come out and review the the workmanship of the job. Nobody has come out to look at our driveway.

We continue to receive monthly invoices. Each time we receive an invoice, we call (nobody ever answers the phone) and leave a message restating our concern with the job that was done.

November of 2011 we sent a letter certified mail listing our concerns with the hopes of coming to a resolution. The letter was returned to us, never picked up. In November we received a phone message stating that Superior Asphalt would come out in the spring and re-do the job.

We continue to receive phone calls concerning the payment and on 2/24/12 we received a letter threatening to send this to collections and also threats of filing a lein on our house.

We have no problem paying Superior Asphalt for the work but it needs to be re-done and to our satisfaction first.

It's extremely frustrating that we have to call monthly only to speak to an answering machine and never receive a phone call back."

Message from Superior Asphalt: Hello Jane, Respectfully, we have also been trying to reach you over the last six months. Our rep has been calling 763.428.1971 which is the only number we have for you. . He has also been out to your home re-inspected the driveway, and tried to reach you in person. His opinion is sincerely that the seal applied is good/normal. We respectfully offer to settle the amount to $80.00 to help recoup at least some of our costs for the sealing of the driveway. Sincerely, Superior Asphalt.

  • Really it's $ 80 and you are to cheap to pay honestly I doubt anyone
    Will respond to your call you let them do the work complained
    And didn't pay these men for their work . And you are upset
    It is still illegal to hire a company or private contractor and not
    Pay for services rendered .
    If you do not like the coating their are the bbb city , county , or state police
    The smaller claims courts the news channels but in my opinion.
    You are betting that these contractors won't sue you for some obvious reasons.
    1. It is not enough money.
    2. They will be out more trying to get their payment than it is worth.
    3. Their is not enough profit really a $80 job must $ 50-60 dollars to do
    4. You will slander them even worse than you have.
    I do not think you really want them back you got a free job
    And your acting like a typical Minnesotan you are mad because they call you and hope Mabey
    You will at least give them the money they where out on
    The Mcdonalds $1.00 menu 6 bucks for 3 guys plus another
    $4.00 so they can gat a soda pop at kwik - trip
