Claimant's opinion: Despite the fact that I should be able to receive free parts under my 1 year warranty, Through my frustration I have gone to other on line scooter parts dealers to get the parts.. only thing is no one else sells the parts I need but BMS, a company that's affiliated with super sportz inc.. When I finally broke down and called them, they informed me that the bike that Tom the owner claimed "just came into the shop" when I called looking for a bike in march 2012 was actually purchased by Tom in 2011 NOT 2012. Which means that the warranty that was agreed upon through super sportz and BMS is now expired, which simply equates to me as fraud. which means that unless tom calls me back and finally makes good on the warranty I will have to pay to get the parts that I need.
Claimant's opinion: When I received the vehicle it was clear that the bike had been dropped, and from what I could tell had not been looked at at all before they shipped it to me, as there was no lock/latch for the seat to connect to. Being that this is a scooter and not a motorcycle this means the seat itself is NOT connected to the bike- which I found out was a huge issue when I hit a bump and almost went flying of my bike at a speed of 30 mph. The trunk which was a selling point for me was not hooked up either- which lead to me having to get a mechanic to come to my home and take apart the vehicle to get the trunk to open. only to find out to my dismay that I was NOT the only one who tried to get into this trunk before. The latch was bent, so when we put it back together again, the trunk itself would not close.So now I had a seat that would not lock, a trunk that would not close, and an ignition that looked like someone had took a screwdriver or "some" device to it to get it to work.
Claimant's opinion: I sent the owner Tom a video of all of the issues the bike had when I received it. For everything that the owner "tried" to do right with this matter, (after many phone calls, and e-mail letters back and forth to the point of nausea ) the end result is me 6 months later still trying to get the parts I need which are supposed to be covered under warren-tee for 1 year. Tom the owner stopped returning my phone calls about 3 months ago, so I had a friend of mine who knows bikes call him to get the parts I needed, figuring that a guy would have better luck. He did, and eventually parts were sent to me- the odd thing was it was all parts I DIDN'T NEED despite the fact that I sent him a video detailing ALL THE PARTS needed.
When I posted this complaint yesterday, I had not yet spoken to Mike from BMS. Prior to speaking with Mike, the customer service representative I originally spoke with explained to me that Tom had purchased the bike in 2011 (which was not as recent as Tom lead me to believe.) Due to this fact , I would have to pay for the parts out of pocket. This was officially the last straw in a string of complaints. I believe that I was a victim of fraud and/or unethical business behavior by Mr. Spiers and his staff.1. For the record, Tom DID NOT express to me in any way shape or form that the bike in question was in his possession for more than a year. In my initial conversation with Mr. Spiers he did indeed try to sell me a higher price point bike- that much is true. However what he failed to mention was that I inquired about ANOTHER bike- which was new and also in my budget. I was ready to purchase THAT bike, despite the fact that the newer vehicle was smaller. 2. Mr. Spiers then went on to discourage me from buying the new bike as he expressed that the L-Roar was a better vehicle for the money I wanted to spend. He also told me and I quote " I just got this bike in, it only has 30 miles on it." This statement made it sound to me that the bike was hardly rode by the previous owner, another words it should be in almost perfect condition... Right? Wrong! Couldn't have been the farthest thing from the truth! For the record it was based on these supposed "Facts" above that I chose to purchase the L-Roar.3. Obviously, I knew the bike was used however Tom made NO MENTION AT ALL of the dangerous flaws/condition that the bike was being shipped to me in. (i.e no latch so that the seat could not lock, the latch to the trunk was completely bent and not connected which meant that I could not get into the trunk AND the entire front piece of the bike was broken in more than one spot.) 4. Mr. Spiers fails to express the many times I was told that the "Parts were being shipped out tomorrow.." I would wait a few days to a week to give it a chance to be shipped to no avail. When I didn't receive the parts after I felt to be an ample amount of time- I would contact super sportz AGAIN! This exchange went on about 4 times, I would get the "runaround" and would be assured by either Mr. Spiers or a member of his staff that it would DEFINITELY be shipped out the following day. Needless to say, The parts NEVER came. (Just so that we're clear this exchange took appr. 2 1/2 -3 months after I purchased the bike! my warranty for parts is only for 1 year)Finally I became so exasperated with being lied to. I waited a few more weeks to see if Tom/his staff would be in integrity and eventually contact me regarding the parts, AGAIN it never happened. 5. Finally as I mentioned in my complaint it took a MALE friend to be in contact with super sportz in June for the parts. FINALLY it seemed that the parts were sent. The interesting part of all this is that initially when I received the bike I expressed all of the issues I found with the bike in a video that I sent to Mr. Spiers, - To my dismay it seemed that Tom ignored the video completely because he did not send me despite my verbal and written plea the parts that I ACTUALLY needed, nor did he make any mention of it.6. For the record, I have been in contact with Mike from BMS and have absolutely no problem with them at all- and Yes, he did say that he would help me, and of course I didn't pay for parts because it's suppose to be covered under my 1 year warranty. 7.What Tom fails to understand is that this complaint has to do with the fact that because of his aloofness, and my last ditch effort to get what I needed by contacting BMS it was brought to my attention that his claim of him "just receiving the bike" was completely false! Which means I was sold a vehicle under false pretenses. I assure you, if Tom expressed all of the downsides of this vehicle, there would have been no way that I would have made this purchase in the first place.Let it be known that it is not my intention to be malicious with this complaint, however I feel Mr. Spiers must understand that if he deliberately refuses to be forth coming with his selling tactics (which I am completely convinced that he was) and he chooses not to do business with integrity, that there will be consequences.I am not, and will not be satisfied with just getting the parts I need for this bike since these issues were not expressed to me outright -to me it's a given that he take care of the parts. In my complaint I also mentioned that he expressed that the vehicle was "ready to ride." Since receiving this bike I have rode it 3 times.. in that time while only going 30 mph, I was completely lifted off my bike when I came across a bumpy portion in the road. Mr. Spiers sold me a vehicle that was NOT only not ready to ride, but one that would potentially put me in harms way. I do understand that in my quote I expressed a $300 compensation fee for the parts that I thought I would have to purchase from BMS. However, I am going continue to ask for this amount because once I receive the parts I will have to hire a mechanic to basically take apart the entire bike to fix what should have been done in the first place.
Mr. Spiers, Is there a reason why you have not responded to my last email? It is my desire to settle this situation as calmly and privately as possible. However, may I remind you that this issue will not be going away despite your silence. Are you really wanting to have a third party become involved with this matter and allow this bad press to go public? The ball is in your court.

This Rene I have spoke with mike at bms and he is working on getting you the parts you need for your scooter and if you like you can call mike at 626-810-8877. Renee, I do realize that BMS is working to get me the parts. However, my last email which sights the faults of your boss Tom Spiers is still at question.( i.e him selling me a bike under false pretenses which equals in more simpler terms, Fraud. Which is why I am seeking damages. Are you able to talk with me regarding this matter? If not, I would prefer that Mr. Spiers contact me himself moving forward.
