Statement of Claim
Claimant says:
"We recently were looking for a home to rent in Suffolk, VA. We saw a property that we were interested in on Zillow. com. We called the listing agent, Anne Hall with Remax Bridgewate, to set up a showing. We told her we had 2 cats and asked if they allowed pets. She replied that this was allowed. When we went to look at the property we again discussed the issue of cats and she again said that this was not a problem. We liked the property and put in an application, along with a $225 application fee. Ms. Hall subsequently spoke with my husband and stated that the owners had, in her exact words, "changed their mind about pets". When I called her to inquire about getting the $225 refunded, she informed me that no conversation had ever taken place about pets and we could not get the money back. Since we do not have anything in writing, we have no other option at this point. I think this is a scam and at the very least, extremely unethical business practice. I would like to make sure that the consumers are aware and that this doesn't happen to anyone else."

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    " First, Ms. Phelps, her husband, son and Mother applied for tenancy at a property managed with the firm. I never spoke with Ms. Phelps until after application had been denied by owner. I was NEVER told or asked about ANY pets before making application. Normally tenants will ask me and in return I will speak with owners and allow them to decide on pets. In the application packet, it clearly states, there is a non-refundable application fee per adult, PAID to a Third Party, which is Kross, Lieberman & Stone. A collection agency that pulls credit reports and background reports for our company. That is where the charge is from. Had any of the applicants told or asked me about pets before submitting application I would have discussed with owners prior to them being charged the fee. While we do feel this is an unfortunate situation for Ms. Phelps, this was done in writing and as part of our process with all tenants. Credit Reports and such cost my company a fee. I am not responsible for Ms. Phelps and her fees. "
