Statement of Claim
Claimant says:
"My name is Mashawn Kelly, my husband Stevie & I met with Les Stone from RAMCO and signed an agreement on July 13, 2015 to have his company install a sunroom addition to our home. We spoke with a gentleman at a booth at the Memphis Flea Market in the Argicenter International Inc. on Walnut Grove, who was advertising RAMCO. He provided us with some material/pamphlets that included pictures of RAMCO's work. We decided to give them a call and a meeting was scheduled.
The meeting was on July 13, 2015 at our home. We discussed what we wanted to have done and we agreed upon $31,995, at that time my husband & I signed the agreement. That agreement included having sidewalks laid on both sides of the house, a small slab for patio on the outside of the sunroom and bricks around the bottom portion of the sunroom, the screen frame on the bricks, the extension of the sunroom floor attached to the original slab already in place.
This proposal was sent to The Association in our Sub Division on July 17, 2015 and returned to us on July 22, 2015 with a request for additional information. Which was resubmitted and returned on August 2, 2015 stating that we must follow precedence set by exiting sunrooms and screened porches in the Vining's SubDision. We made RAMCO aware and Mr. Stone sent us an offer from a company with no name on the letter stating they would do the roof as requested by the Association for a total of $12,620.00, which we discussed but did not sign an agreement. Mr. Stone sent us drawings of the roof and this was approved by the Association on October 20, 2015. RAMCO did not start the work until December 2015, nor did they disclose to us that they were contracted with different companies to do the job. We wrote him a check which he asked us to make payable to RAMCO in the amount of $380.00 so that he could pay for the drawing. We provided him with our credit line account number to pay half down on the sunroom which he was going to charge and later we would charge the balance once the work was completed. They sent 2 people to lay the foundation, sidewalk, and bricks, which took over 2 months to complete and they left cement on my house, windows and in the yard. The floor of the sunroom was never smoothed out and the men sent to do it stated they could not return because they were being sent to another job. Another month to send a company to do the roof. Three weeks later an Electrician came to do the outlets and wiring for light and ceiling fan, which he could not complete due to the screen frame had not been installed to put the lights that we purchased to put outside of each exit door (x2) of the sunroom. Two weeks later I contacted them and asked when would they be completing the sheet rock for the sunroom because birds and wasp were flying and I was concerned that a nest would be in the open celling space by the time they put the ceiling up. One week later they sent another group of men to complete the screen stating Mr. Stone asked them to come as soon as possible because we had mentioned we were concerned about getting a nest. The screen was put up the first week of April 2013. No work has been done since that time. We have been in constant communication with RAMCO and they have given us one excuse after another. This project has taken longer than it took to build our home. I would like for RAMCO to complete this job by the by May 1,2016 at the original agreed upon price of $25,000 which I feel is more money that should be paid for the quality and the amount of work and the time it has taken to get this project done.. They have quoted my husband a price of $44,000 which we have not agreed to nor signed an agreement for. They have provided us with very poor customer service and it has taken more than 6 months to complete the project after receiving approval from our Home Owner's Association."

  • I have a couple of questions before  I can offer a solution.


    1. How much has been paid to Ramco?
    2. Have they made payments to any of their sub-contractors?  If so,  do you know how much and to which?
    3. Was there a  provision for change orders in your contract?  Are  they claiming higher costs due to change  orders?   If  so,  how have they documented any CO's?
    4. how they provided you with any  written explanation  for the delays and  cost overruns?
    5. Its after May First.  Any progress?
