Claimant says:
"IN SPITE OF MY SEVERAL APPEALS TO THE TWO H.O.A'S FOR A REDUCTION OR AN EXEMPTION FROM THEIR ANNUALLY INCREASING OVER- PAYMENTS ( ASSESSMENTS) AS A SENIOR CITIZEN DEPENDENT ON THE SSI , THE ABOVE H.O.A'S ARE INSISTENT ON COLLECTING THE FEES , IRRESPECTIVE OF MY APPEALS FOR HELP. I WISH THAT THE STATE OF ARIZONA RESCUE ME AND MY DISABLED WIFE FROM THIS FORM OF WHAT SEEMS TO ME AS HEARTLESS 'EXPLOITATION.
KINDLY NOTE THAT I HAVE CONTACTED MANY AUTHORITIES TO HEP ME IN VAIN."

  • How much is the HOA fee? If you live in a community, there are expenses for maintaining the property. It's hard to know whether the fees are reasonable or not without knowing the amount.  

    My friend is the president of a volunteer HOA board and will be glad to weigh in if you give her something to work with. She shops landscaping services etc. very carefully to get good value for the residents, but nothing comes free.

  • I think it is a real shame when someone is older or disabled and is forced out of their home by the cost of HOA fees so I hope that you can come to a reasonable agreement on this. I am thinking of my parents and hope this doesn't happen to them.

    I wish I could say that I think you have a good case but I can't say that I do, not with the information given so far. It is not the management company's problem if you can't afford to live there. 

    It might be helpful if you say whether the costs have risen a lot and if so why. If you moved in with low HOA fees and then the HOA began expanding services dramatically that is important. Say you moved in and the HOA fee was $200 a year for keeping grass mowed, snow plowed etc.  with a volunteer board, then the HOA decided to add a paid management service and an Olympic swimming pool. you might have an argument to say that you did not agree to these costs and moving would be a hardship. The HOA might give you a compassionate exemption. 

    I think you need to explain a few more things.

    Why are there TWO management companies? Is one the owner of the property? What development is it?

    How much was the HOA fee when you moved in and how much is it now? Why was there an increase?

    Have you gone to the HOA board and explained your situation? Have you attended HOA meetings as long as you lived in the development?
