We spoke to the CPA as requested by this client. More profit was taken than expected. There is no way for Paychex to be aware of this, we can only base tax withholdings based on payroll reported to us and using the government issued tax tables. We are not the CPA, we do not know the personal or business dealings of the clients.Update 1/6/17Paychex was clearly instructed to add an amount to cover distribution taxes. Please refer to the email attached to initial complaint. Response was that taxes for distribution were included. I reported the distribution amount for every single pay period thinking it was included based on the information I had. Even if what you’re saying is correct you had the responsibility to inform me about that regulation. You are the professionals and I know nothing about taxes. I did not find out that nothing was added for distribution until I received the tax liability for $18,000. We will have the same issue in 2016. I understand we owe the taxes but had someone communicated to us that you were not able to collect taxes for distribution, the outcome would have been much different. Shouldn't the account servicer checked with someone more experienced when I brought up the issue before giving me the incorrect information? That is the negligence which caused the late fees and penalties. If she found out she was not able to pay taxes towards distribution and decided not to disclose that information is also negligent along with the fact the lack of communication. In my profession, I could lose my license for not disclosing pertinent information. Monday, January 1, 2017, we went to a CPA with all our tax returns. On that day, we discovered that Paychex had given me the incorrect information on the net amount to pay our employee. She gave me a net of $459.57 when it should have been $400.75. That is the difference of $100+ each month. We will need to cover the difference for Real Lemmons Inc as well as our employee. I am now increasing my demand to $4500. Please see the attached documentation. I have saved all email communication between the account servicer and myself. I have enough information to take this to an attorney.
"Taxes were withheld exactly as requested based on IRS tax tables. Per robin's request I spoke to her CPA about this matter. Paychex has no way of knowing the amount of profits to be taken by a business owner. It is there obligation to make estimated tax payments on amounts they intend to take as profits. If a client would like to withhold amounts higher than shown on the IRS tax tables they would need to request it. Again, Paychex is not the CPA or tax advisor, we can only use the legal tax tables to calculate taxes based on amounts reported to us. We have no knowledge of what will be reported on personal income taxes, such as deductions or other income."

If I understand this properly, the claimant reported both distributions and payroll to Paychex on the worksheet provided by Paychex.
It is incomprehensible to me that month after month, Paychex would look at the numbers for distributions provided by the claimant and not think to mention that they weren't including that in the tax numbers. Maybe the letter of the law doesn't require a payroll service to account for distributions, but minimal customer expectations do.
If Paychex employs drones who can't think, then it probably needs to reconsider its hiring practices. The claimant is absolutely correct in saying that they aren't experts and that is why they employ experts. We all need to rely on experts. Imagine taking your car to a mechanic for an oil change and the mechanic not mentioning that your brakes are falling off because they were only required to give you an oil change.
Obviously Paychex can't account for distributions not reported to them. But if the claimant was dutifully reporting distributions and Paychex never thought to mention that they weren't accounting for them in tax calculations, then I'm pretty shocked.
In my opinion, if the information provided is correct, Paychex at the very least did not earn its fees and should return them.
