Statement of Claim
Claimant says:
"We were on our way home to Denver. We were 20 miles north of Douglas Wyoming when our car started to overheat. We pulled over and cooled the motor down and filled it with water then we drove the 20 miles into Douglas. We stayed the night and the next morning I called One Stop and asked the for a quote on a thermostat. They quoted me $169. We took the car in and it took them 21/2 hours. When it was done he had charged us $269. They never notified us that it was going to be an extra $100. We paid it and they said we were good to go. We got about 5 miles south of Douglas when there was a puff of smoke and all the oil was on the ground. We called the shop and told them what had happened. They sent us a tow truck which was $85. When we got back to the shop they checked it out and said we had a blown motor. All that was wrong when we took it to the shop was a bad thermostat. The car was running great when we walked into the shop. When we left the shop the car was far from alright. We asked them to give us our money back and they refused. The mechanic should have checked the fluids before he was done beings we told him we had an overheating and that we thought it was the thermostat. For the extra $100 he should have checked it more. We only had the car for 3 weeks."

The claimant's settlement terms were rejected with the following explanation:
  • "The Claimant called into One Stop Auto Plex because their 2002 Chrysler Concord had been overheating and they wanted to have the thermostat replaced. They requested the cost to replace the thermostat with the claimant , supplying the part. She did not want the problem diagnosed simply just the thermostat installed. She was given an estimate of $169.00 for labor only to install the thermostat on the vehicle sight unseen. One Stop asked the claimant (since the vehicle had overheated) if the vehicle was drivable or if it needed to be towed into the shop, the customer chose to drive it and arrived shortly after the phone call. The shop was busy at the time of arrival, and understood that the customer was traveling and in somewhat of a hurry, and advised the customer that they would get it in as soon as possible. The claimant opted to take the vehicle and go get breakfast while they were waiting. The claimant arrived at the shop shortly after and One Stop was able to get the car in. Once the vehicle was in we noticed (the shop) that the vehicle was very dirty under the hood and installing the thermostat was more labor intensive then it was estimated. One gallon of coolant was added (which was not provided by the customer so it was an additional cost). It took approx 2.5 hours to install the thermostat. The labor was actually about $62.00 over what the original labor estimate, and including the tax, shop supplies, and coolant put the total about $100.00 over what the estimate was. The shop could not have stopped in the middle of the installation to ok the additional amount; the bill was created on the time it took to install the thermostat. If the claimant had problems with the amount to begin with the claimant should have said something to the shop at the time, which they did not. The claimant paid the bill, and left the shop. Approximately 20 minutes later the shop received a call from the claimant stating that they were 5 miles from Douglas and they had broken down. The shop owner advised that they could have the vehicle towed in and the shop would look at it. The vehicle was towed to the shop (at the claimant’s expense) and the vehicle was looked at for free. The shop advised that the damage to the motor had already been done due to the claimant driving the car after it had overheated and caused more extensive damage and replacing the thermostat did not fix the problem. The shop advised that it was more likely a head gasket or a cracked head. The claimant chose not to fix the vehicle and its still sitting at the shop abandoned as of 3/27/2013. The damage was already done to the engine, however the claimant thought by replacing the thermostat it would solve the problem. This was not the case and as soon as the car was driven far enough that the engine got hot once again. Due to the fact that the repairs on the vehicle were a self diagnosis by the customer and the customer supplied the part, and did not want to have the shop nor pay for a proper diagnosis, the shop did as the customer requested, as well as looking at the vehicle when it broke down the second time for free. One Stop Auto Plex is at no fault for this claim nor will the shop be reimbursing the claimant any money."
