Statement of Claim
Claimant says:
"I have a property in Hawaii that is financed by Ocwen and had incurred a roofing damage and my insurance (State Farm) sent the payment to Ocwen on Nov16, 2012 and until now their loss dept is not releasing the check for the contractor who does not want to start the repair until he can have 50% advance. The house is getting more damage now. My insurance has been contacting them several times to send the check with the right name, and almost every day for one month, I have been calling them and I spoke to Beatty, Stacy ,Jessica, Roxanne, Hardy ,etc and they are putting me on hold and they kept on telling that they have to refer this matter to specialist. This has been going on for more than a month following up. They will send a check putting wrong names on the check which the bank of the contractor will not accept and several faxes and calls from the insurance to instruct them how to name the check but they still do erroneous names. They did this for two times and they stopped payments for those two checks with errors."

  • Ocwen is, unfortunately, a repeat offender in this sort of situation. In addition to all of the advice already given, you should also contact your state’s department of insurance or an agency that has similar power in the state. They can also be of assistance since it is the proceeds of an insurance claim that is being withheld from you. Going forward, you will also want to make sure that you continue to maintain homeowners insurance on the property, as mortgage companies can and will try to place force placed insurance on properties and attempt to recoup the cost of a much more expensive policy from you.

  • Due to the fact that State Farm has paid out the amount due for damages and Ocwen has not fulfilled their obligation to pay, you might want to ask State Farm if they intend to pursue legal action. They have a legal department to confer with to find out if that is warranted. If they are not, you may want to consult an attorney to find out how to get the money to the contractor and get your house repaired. From doing a quick Google search, you are not alone in having these issues. This seems to be the m.o. for this company. According the the BBB, there have been over 1600 complaints in the last 3 years with this company.
