Statement of Claim
Claimant says:
"I have sold my house and in the inspection one of the fifteen windows I bought with a guartnee for life has broken a seal. I go to settlement on Jan. 20th. I am a disabled person with Emphysemia and Osteoporosis. Jeffery Witkin, Executive Vice President says his company is closed until the 2nd of Jan and the glass makers are closed till the 15th. He says if I will bring the window to him between 7:00 and 8:00 AM he will have it fixed by 3:00pm. With my medical problems I can not set and wait that long. Also with this being winter, my house would get very cold. I asked if I could buy a window till he fixed mine and then he could pay me back. He says that he has stoped making this type and he has not one to bring one to me anyway. I can get one made here in Hammonton but it is going to cost over $100.00 and I live on social security. I am already loseing over $130,000 on the house because of the market. My doctor says I must move to a dryer climite so I can breath easer. I am sure a large business like his could either replace the window or pay for the company in Hammonton, NJ to fix the window."

  • Our company is currently closed for the holidays till January 2nd. We are a company that has been in business since 1975 and always values its customers (we sell wholesale only to contractors and dealers), and always hope that our products are proforming well in the marketplace. Mr. Coverts' windows if ours were manufactured back in 2004 I guess (I say this as he has not even given us the time to look up his order and validate that its even our product). We do have lifetime warranties on the glass, and he is INCORRECT, as we still to this day manufacture a Trustgard window (I believe this is what he has) and we have printed warranties that detail how to go about getting replacement units when a failure (seal failure occurs), and they are on our products and our web site. Mr. Coverts postion is unfortunate that he is physically unable to come to our manufacturing facility, however we will be able to manufacture a new top sash and have it available for picking up. It appears that becasue HE has a settlement upcoming, he is looking for a swift replacement unit to be shipped. We do NOT ship glass and the units will break with handleing from UPS or another carrier.

    Mr. Covert should contact the selling company (Party-in this case Apex) and ask them to do the "leg work".

    Our warranty is fair, printed and easy to understand.

    We always do everythign we can to help any of our customers, direct or indirect.

  • He email me and asked me to withdraw the complant. I told him that after buying 15 windows he was treating a customer very bad. I also told him that I am going to have the window fixed here in Hammonton and if he wanted to do something he could help me in the cost which is going to be over $100. Now I will see what he has to say because I can not wait till the 15th because the people will reinspect the house before that since the settlement is on the 20th.

  • We have returned from being shut down for the holidays and most of our new glass equipment is in place. We would be happy to honor our printed warranted and will remake a new top sash for Mr. Covert, not just insulated glass as required by our warranty.

  • The house is sold and I gave the owner $150 to replace the window because the company could not take care of the business because they were closed. They did not like my suggestion about spiting the cost. I now live in Nevada on the doctors suggestion. If he wants me to remove my complaint he can send the $150 because now that I have paid it I do not want to split the cost.

  • Our company has a printed warranty which covers replacement costs only. We always have and always will replace any unit that fails under this warranty. Mr. Covert had every opportunity to fulfill our warranty, but chose not to do so. Any warranty claim could also be filed by the purchasing party (contractor/dealer) or the homeowner. We do not include trasnportation costs or fees, just cover the costs of replacement products. We do not reimburse anyone for replacement of same.
