Statement of Claim
Claimant says:
"I was lied to and cheated! Have tried to talk to them and just get more lies. Them and people like them are why this country is in the mess it's in, caused by liars and theives. Was told I was buying an AWD vehicle, and after getting home found out I had a FWD vehicle, worth much less, and not what I wanted. There was a certified vehicle sticker on the vehicle and they said it had been thoroughly checked. The battery was dead and no good, and the air filter was full of dirt and looked like it had never been checked. I had a 2010 toyota yaris with 16000 miles in perfect condition still covered by Toyota care, that I was conned into trading for a nissan rogue with 82540 miles which was supposed to have warranty to 120000 miles and AWD. Both of those were lies, The transmission is covered to 120000 miles only, and it is FWD only."

The claimant's settlement terms were rejected with the following explanation:
  • "Elmo Smith is welcome to come speak with me, his warranty has already been cancelled per his request. We replaced the battery and air filter at no charge to customer. We are a triple "A" rated company with the Greater Knoxville BBB."

  • According to the FTC, the dealer is required to state specifically what the warranty covers on the Buyer's Guide, whether it's a full or limited warranty and what parts those warranties cover. You should have been given the Buyer's Guide when you bought the car so look that over and see what it says. If it does in fact mention AWD and the warranty you say you should have, then the dealer is should pay you back the difference of the FWD and honor that warranty. I would then go over all the paperwork you signed and make sure you signed what you thought you signed. Also, as a buyer, it is your responsibility to ask if a pre-purchase inspection is possible. You should never rely on spoken promises either.

  • It doesn't seem like they have yet to address the biggest issue, being the vehicle is FWD and you wanted AWD. The window sticker and all paperwork should have clearly stated if the vehicle is FWD or AWD. If the paperwork is incorrect, I feel that the dealership owes you the difference in price as you have requested. There is a difference in not only value but how the vehicle operates and handles in different weather conditions. I might also suggest that if you were told or led to believe there was an overall extended warranty on the vehicle and not just on the transmission, you should request they add that warranty to the vehicle at their expense. Please reread your paperwork and contracts. I am not an attorney so I cannot speak from a legal standpoint but the contracts you sign and initial to buy a vehicle are very detailed and attempt to mitigate lawsuits or claims from the purchaser. See what the paperwork states and what you have signed and agreed to. I hope you and the dealership are able to work something out. A vehicle is a big purchase and you should feel satisfied with your choice. Good luck.
