Statement of Claim
Claimant says:
"In 2010 we purchased a frameless showerdoor and a large wallmirror and had both installed by mirrors and more. A few month ago I noticed the showerwall, where the door was mounted to, was pulling away. I contacted the co. and was told they are not responsible but they would take the door off so it could be repaired. The guys from mirrors came and took the door off and assured me after I asked what did they screw the heavy door to, they answerd oh we put wallanchors into studs and slapped the wall to demonstrate that there are studs where they srewed in the door. Then I noticed that they stepped into the shower without protective shoecovers and made the tub very dirty. Right before they left to my surprise they handed me a bill for $200.00. I called the co. and asked for an explanation and was the told they assumed that there was a wood wall behind the fiberglass wall but they never discussed that with us. I told them that they are the pros that is why we choose them to install, because we do not know what are the conditions have to be to install such a heavy door, but they should know, it is their business. So Phyllis Bowen then said she would speak with the president of the co.and would call me the next day. That was April 16th. She never called but we received another bill on May 4th this time 150.00 and the stipulation if paid with cc there will be 10% added to the bill. We had to put up a scaffle and look behind the siding to see how to repair it.That cost was $400.00.I tried to call the day after we got the bill and resolve this situation but they neverv seem to be in the office during reg hours. We did take pictures off the wall from behind the showerwall to demonstrate that they did not screw anything into any studs."

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"When Mirrors And More, Inc was contractacted to measure and install a Frameless shower enclosure and beveld mirror for Mrs. Anderson it was in a newly remodeled bathroom in January 2010 and in April 2012 2 years later i was contacted by Mr. Anderson and was asked if we repair shower WALLS. She had made it perfectly clear that her wall was coming apart and that the Frameless shower door was fine. I then informed her that she had to contact the contractor that installed the wall, also informed her that if she needed us to remove the shower door that we would could so. She also made it very clear at that time that the problem was with the wall not the door. After she contacted the contractor she then called me back to schedule and appointment for us to remove her shower door on April 9th, that morning she rescheduled the appontment for the following week April 16th. When our installation crew arrived that found the Frameless shower door very much in tacked and very secure to the wall. I do appologize for my crew not wearing booties in her tub, however the tub was cleaned by my crew prior to them leaving the house. There is no state code that requires a stud in the shower wall for a shower door to be hung off of. So i am very unclear as to how that a stud can become an issue when it is not even required by any state building codes for shower installation. As for the labor charge whenever anyone calls a company to schedule a day and time to have a crew show up to perform a removal or installation of a product they are very aware that there will be a charge. As for the credit card the note was made so that the customer was aware of it. That is what we are charged for every credit card transaction and we charge the customer that for the convience of credit card usage. Mrs. Anderson's grief should be with her contractor in which who hung her wall and is now charging her to repai it. The shower door had to be removed because of his error Mrs. Anderson should have him pay the labor fee for the removal of the shower door. Again the shower door had to be removed because of the wall coming down not because the shower door was coming of the wall."

  • I did not agree with the Mirrors and More because when I employ a socalled expert I expect the Job to be done right. An expert schould know how to properly install a heavy glassdoor to a showerwall.
