Statement of Claim
Claimant says:
"We are both listed in a will by my mother helen neurer. marvin was placed in charge of the property at 26615 Potomac dr sun city ca. The will further states if he can no longer handle the responsibilities, then I Daniel hill would take over as person in charge.

I have no way of knowing if the payments are being made ,or if the house is being taken care of.
I would like a letter from the bank who has the deed, giving me a financial history of the payments .

I would also need to know if the taxes are being paid."

  • At the time of our mothers death. If I was alive. Her half of the house goes to me, Marvin Neurer. I have always been on the mortgage of the house. My name is the only name on the house. My mother and I bought this house together. This is Harassment by Danny hill. In the Living Trust. It calls for Back up Beneficiaries, Just in case I die. Before my mother.. It names. Ralph. Bobby. Danny. No one, is giving me any problems with this. They know and understand. On 10-24-16.There is a response to this claim. My mistake its private. I tryed to change it to public, doesn't work.

  • I read both the claim and the comment by Marvin Neurer. Please confirm which of the following is accurate:

    1) The home was jointly owned by Mr. Neurer and his mother with right of survivorship. This should be easy to verify.

    The mother's will states that if, at the time of her death, Mr. Neurer had already died (in which case the house would have gone to her as survivor) then the house would go to other parties, including the person making this complaint (Danny Hill?).

    Since the mother was the first to die, Mr. Neurer wholly inherited the house as the survivor. 

    If the above is accurate, then it is frankly none of the claimant's business as to whether the house and payments are being kept up.

    2) On the other hand, if the home was jointly owned WITHOUT right of survivorship, and half of the home is now owned by another party or parties, then those parties DO have a right to know the financial status of the home and also the obligation to ensure that the mother's financial responsibilities are taken care of by them--even if Mr. Neurer is assured of sole occupation of the home until his death.

    e.g. if the mother was co-signatory on the mortgage, all heirs to her half have the responsibility to make her payments, and to pay for 1/2 the maintenance and 1/2 the taxes. With rights come responsibilities.

    The executors of the will have a legal and ethical obligation to ensure that all provisions of the will are carried out in the best interests of all the heirs.

    Marvin, the person in charge per the will, should communicate the status of the property at least once a year to Mr. Hill, and anyone else concerned.
