Claimant's opinion: Believe that Mabbco's disclaimer of implied warranties and disclaimer of warranty of mechantability is both unethical and illegal. Also believe Mabbcos statement of 12 month/ 12,000 mile warranty is misrepresentation and fraudulent advertising.

Because of the expense of shipping, installing, and uninstalling an engine, requiring that an engine be returned for repair is disingenuous at best, fraudulent at worst.
I looked at MABBCO's warranty and it's confusingly written. To start with, it's written in Legalese - a language designed to obfuscate. It takes quite a long time to get down to the process for repair. There it is:
"In making a warranty claim, the Customer is required to provide MABBCO with the Customer’s original repair order, sales receipt, or invoice...BEFORE ANY REPAIRS CAN BE MADE, A REPAIR AUTHORIZATION NUMBER MUST BE RECEIVED FROM MABBCO. DISASSEMBLY OR REASSEMBLY OF A MABBCO LONG OR SHORT BLOCK OR ANY COMPONENTS THEREOF WITHOUT AN AUTHORIZATION NUMBER RECEIVED FROM MABBCO VOIDS THIS LIMITED WARRANTY."
However, the average person isn't even going to wade down that far - they're going to look at 12,000 mile/1 year warranty and think it's worth spending the money for the engine and the associated costs, because they're guaranteed to get at least a year out of it.
A cursory check on the web shows a lot of similar complaints. If MABBCO was any kind of a decent business, they'd establish a protocol. In these days of internet search and Skype, it takes nothing to schedule a video call with the repair person, establish that there's really a problem and that the mechanic is qualified to fix it, and pay them the money.
If MABBCO were an honorable business, that's exactly what they'd do.
I don't believe that the claimant is entitled to everything he's asking for, however painful the whole experience has been. I DO believe that MABBCO should pay for the repair and clean up its warranty language and its protocol for repairing faulty engines.
