Statement of Claim
Claimant says:
"On Tuesday August 1, 2017. I parked at the Peabody parking gagage in Birminham MI. I entered the elevator on the 5th floor at around 3:12 pm .I was taking it down to the 1st floor to get off. The elevator proceded down toward the 1st floor, then startred shaking and came to an abrupt haled stop. Shaking me hard. I was the only one in the elevator. I stood in shock and said to myself, Please tell me I'm not stuck in this elevator, because that did not sound good. I looked up at the floor sign it was blinking 1- 5. I said that's not good. I stood there for a few minutes in shock and then I tried to open the door by pushing the open door button. It didn't work. Next I noticed a call button, I said great I can call for help. I pushed the button but all I got was a busy signal. I noticed n light button next to the call button. and some words that said if the button is red the fire department as been notified. I said good but then I noticted the red button wasn't a solid red but only flashing red. So I wondered if it worked. I waited about five minutes and noticed the light stop flashing so i said to my self I don't think this as working now what do I do. Then I remembered my cell Phone. So I called 911, but I got no reception. So I tried again this time I got closer to the window . And dial 911 my call went through. The operator ask me the nature of my emergency I told her I was stuck in an elevator. I was in a parking gagage in Birmingham behind the Birminingham 8 Movie theater. THe operater said there were several in the area which one was I in. I told her what from the street. I was near the Jax car wash. She asked me what floor I was on I said I thought I was near the 1st. Because i could see the street. She asked me If I was injured I said no I didn't think so, but it was hot in here and getting by the minute. But get me out of here. She told me the fire department was on its way I thanked her and hung up. I kept trying to get the attention of people I saw walking by from the window. I got a young mans attention and signaled to him I was stuck. He understood and called for me. The fire department arrived and got me out. I was so thankful. They took my name, address and phone number. And I Left. 
I called the Peabody parking garage the next day to tell them about what happen. I asked for some compensation for the 25 mnutes I spent in a hot elevator. He asked me if I wanted to file a claim I said yes and he said someone would call me in a few days. Instead I received a letter from their claim department. I called him explained what happeen , he recorded the call. Then told me I had the wrong company. The parking garage was not responsibile for the elevator. and gave me the elevator company name.
I called Kone and spoke with the supervisor of this area. Dave Bumudz. He basically told me that since I wasn't hurt and didn't go to emergency that there was nothing they could do. I told him how shook up I was and my concern about the call button not working and how nervous this situation had made me. I just want reasonable compensation for what happened to me. He said he would check into what happened and give me a call back.
I let a week go by and called him back, He told they were not responsible but the parking garage was. His company only serviced the elevators. And he had reported my situation to The City of Birmingham. First he offered to give me the name and phone number of whom he had been talking to. Then he changed his mind and told my name and phone number to give to them. I feel like he was just passing the buck.
So I called Peabody claims adjuster and spoke to him, He just told to call the corporate office of Kone Elevators so I did. I got passed on to a man in ChIcago Named John Olson. Told him my situation and told me I would have to take them to court. I tried to tell Him I don't to do that I just some compensation for what I have been through. He told the only way I would receive that would be to hire an attorney and sue.

  • Why hasn't Kone responded to this claim?  This is an enormous company, with a product that affects public safety on a daily basis around the world.  A malfunction with their product caused this user an unpleasant confinement.   Also, does anyone know technically whether the garage itself is off  the hook (as they claim to be) for an incident occurring on their premises in the elevator they provided?
