Statement of Claim
Claimant says:
"My child Angela Kuchuk was enrolled in their summer camp program, they requested a payment upfront in May. They received a payment of $1705 on May 27. She attended the camp for the first 2 days on June 29 and 30, 2016, but refused to attend the next day due to being attacked, threatened and bullied by two other girls in her group, the counsellors were not present and my child had to endure the suffering until I picked her up and took her home. I went to ask the Kings Bay Y for a full refund, but they stated that they will not refund the money and accused my child of lying about being bullied and left without supervision. She is 8 years old and goes to camp and after school and swimming classes in the same location since she was 7 months old, I never saw anything like this happen before. I was harassed as a parent and they made me stand outside with both of my daughters, begging them to refund my money, that were paid for my child to enjoy herself in summer. I had to take her to see a dr and I have a note stating my child is having panic at tacks and anxiety, the dr wrote a recommendation to stop camp and referred me to a child psychologist. I have evidence and all the paperwork that supports my claim."

The claimant's settlement terms were rejected with the following explanation:

    "After reviewing your claim we followed up with all of the staff that have worked with your child. As well as discussed the incident that involved the claimant on the day that she pulled the child from our camps.

    There have been no incidents of bullying, nor has any of our staff ever brought any bullying issues to yours or your spouses attention. This is the first mention of any bullying on yours or your spouses part as well. Also please be aware that there has been no incident whatsoever involving your child getting hurt at any point while attending our camp.

    The incident that involved you was documented by our staff. You came to the drop off location for the camp in front of 3495 Nostrand avenue on Friday July 1st, 2016. You stated to the staff that you will no longer be following the camp protocols and will not be showing your ID at the time of the pick up. You proceeded to state that "if the camp needs your ID we should copy it and have it on hand". You were instructed by our staff again, that any person must show ID at pick up and that it is the camp's policy to do so. At this point you escalated, and started cursing and screaming at the various Supervisors and Directors who tried to speak to you. After this, you made a choice to take the child out of camp due to the fact that we did not want to change the camp's security policy on pickup.

    Since there was no incident whatsoever involving your child (bullying or any physical injury during camp hours) and the choice for you to take Angela out of camp was based (as per your own words to our staff) on the fact that you didn't want to conform to our security policies, we will not be issuing a refund to you for the summer day camp. "
